These Booking Conditions set out the Terms of Contract with us so please study them carefully. Your contract is with a South African citizen trading as Villa Kasbah.

4. Cleaning Service
Monday to Friday housekeeper service is included. Public holidays are excluded. Should you require any service on Saturdays we can provide that free of charge by arrangement. For public holidays, you may arrange it with the housekeeper privately and pay her/him in cash the agreed amount. The cleaning service does not extend to personal laundry and cooking. However, personal laundry can be arranged with the housekeeper at an extra fee to her/him directly.
5. Other services included in rental cost
The rental cost includes electricity, water, council rates and levies, satellite TV, 6gigs wireless internet, pool cleaning and garden service.
Linen, bath towels and beach towels, hairdryers and liquid bathsoaps are provided.
6. Arrival and Departure times
Check in time is at 2pm on the day of arrival and check out time is at 10am on the day of departure. We will try to accommodate any reasonable request for an early check-in or late departure but this cannot be guaranteed should previous guests be leaving the day you arrive, or new guests arriving the day you depart. Management may ask you for an additional fee payment to secure your early arrival or late departure that might entail having to bring in extra staff to prepare the house. If this is important to you, please request this prior to booking.
7. Cancellation by you
If you wish to cancel the booking, the person who signed the booking form must do so by notifying us in writing via email or fax. Your notice of cancellation will only be effective from the date of its receipt by us. On cancellation eight weeks or more before the rental we will refund the full deposit; eight to four weeks before the rental 50% of the total property rental paid shall be retained; and four weeks and less prior to the rental, 100% of the property rental paid shall be retained.
8. Alterations and cancellations by us
It is very unlikely that we will have to make any changes to arrangements once these have been confirmed. If this does happen we will let you know as soon as possible. If, for any reason beyond our control, we are unable to provide you with the property you have booked, we will cancel the booking, refund the full amount paid to us for the property, but we will not be liable for any cancellation charges for travel arrangements or any further claims by you or anyone else in your party.
Unfortunately this property is not very child friendly and the issues of concern for guests with younger children are steep drops from the top and pool patios, open stairs and landings and an unfenced pool without pool cover. Guests staying with children do so at their own risk and are urged to take all due care and attention during their stay. We do not accept any responsibility for any injuries on this property.
10. Swimming Pool
The pool is to be used at your own risk. It is not supervised nor normally equipped with safety net or a fence. We can however provide you with a safety cover upon request and assist in putting it on.
It is heated upon request only so is normally only suitable for summer swimming. Should you require pool heating we would need at least 4 days notice to have it warm for your arrival. During very cold, rainy and windy winter months the pool heating is not very efficient and will never quite reach a “hot” stage.
This pool is cleaned every second week and while we will endeavour to arrange additional cleaning service if required during your stay (excluding week-ends and public holidays) we cannot always guarantee that the pool will remain completely clean during periods of extreme weather conditions.
11. Telephone and internet services
The telephone facility is for local calls only. The wireless internet facility is free for up to 10 gigs after which more can be purchased. It is the fastest speed we currently have available in South Africa and would seem slow to you coming from a more first world country.
12. Maximum number of guests
Only those persons named on the Booking Form may use the property and under no circumstance may the total number of people sleeping on the property exceed the maximum number stipulated. We are entitled to request you and your party to vacate the property if this rule is not complied with.
The person who signs the Booking Form is responsible for the behaviour of everyone using the rental property during the rental period. If anyone in your party or any guest or invitee behaves in an unacceptable manner by any civilised standard, the entire party may be required by us to vacate the property without further notice. It is not considered acceptable behaviour to make excessive noise including playing music loudly especially between 11pm at night and 7am in the morning, and such behaviour will not be tolerated as this property is in a quiet residential area.
This is a non-smoking property and you are kindly requested to refrain from smoking inside the rented premises. Ashtrays are provided for outside use so please do not litter the garden with cigarette butts.
It is your responsibility, and that of each of the persons named on the Booking Form:
(a) to pay for any losses or damages to the property or premises, however caused (reasonable wear and tear excluded)
(b) to take good care of the property and leave it in a clean and tidy condition at the end of the rental period
(c) to permit the property manager reasonable access to the property
(d) not to part with any possession of the property, or share it, anyone other than with members named on the Booking Form and
(e) not to cause an annoyance or become a nuisance to occupant of adjoining premises.
NB) It is the responsibility of the person named on the Booking Form to insure that the alarm is set and all exteriors doors and windows are closed every time the property is left unoccupied. Due to high velocity winds and unexpected rain, it is imperative that the glass doors and windows are secured properly when retiring or when leaving the premises as well as any outdoor cushions that have to be stored inside. They tend to fly away in the wind and you will be held responsible if they are blown away.
16. Property descriptions
The property descriptions used on our web site or otherwise provided to you are made in good faith and are believed to be accurate.
17. Complaints and problems during your stay
If you have ay complaints and problems during your stay, please let us know as soon as possible so that they can be remedied. However, we are not responsible for issues out of our control such as failure of the water supply, electricity, telephone and internet services, pool filtration, or any of the appliances. We also do not have control over building works on neighbouring villas nor are we told before the time of intention to build. We will do our best to resolve any problems as soon as possible once notified of them. We must stress the importance of bringing complaints or problems to our attention as soon as possible during your stay as we cannot be expected to help if you only notify us following your departure.
In the event that you vacate the property without our notification during the rental period, you will lose any rights you might otherwise have had to compensation.
18. Breach of contract
If any one of these conditions is breached by any of the persons named on the Booking Form or any of the guests or invitees, we reserve the right to enter the property and terminate the rental agreement with immediate effect.
We do not accept liability for any act, neglect or default for any accident, damage, loss, injury, expense or inconvenience, whether to person or property, which any of the persons named on the Booking Form or any of their guests or invitees may suffer or incur arising out of, or in any way connected with, the property rental.
All guests are strongly advised to arrange comprehensive insurance against travel and other related risks as any loss or damage including theft of personal items cannot be claimed against the property insurance. It is the responsibility of the persons named on the Booking Form and those accompanying them to fully insure their personal items and also to keep the property secured by setting any alarm and securing all doors, windows and gates when going out.
21. Authority to sign
The person who completes the booking contract form certifies that
(a) he or she is authorised to agree to these conditions on behalf of all persons named on the booking form, including those submitted at a later date
(b) the signatory is over eighteen years of age and a member of the party intending to occupy the property and
(c) he or she takes full responsibility for any persons occupying the property during the booking period.
22. Governing law and jurisdiction
South African law shall govern the validity, construction and performance of these conditions. It is agreed between us, and the person named on the booking form, that any dispute shall be subject to the exclusive jurisdiction of the South African Courts.
We will also require guests to sign the following Noise Agreement:
Thank you for choosing this villa for your upcoming visit to Cape Town. We do hope you will have a wonderful time in our beautiful city.
This villa is situated in a quiet residential area and we need to adhere to strict noise control measures implemented by the city council for this area. We therefore need you to understand and accept the following conditions:
1. No loud parties of any kind are to be held at the villa.
2. No noise or music of any nature (heard by neighbours) are allowed between 10pm and 7am during the week and between 11pm and 7am on week-ends.
3. No hooting or shouting in the street at any time (day and night). Failure to comply with the above will result in the following:
1. R500 fine for every call-out to the villa to warn (and quieten) you should we receive excessive noise complaints from neighbours.
2. Should it come to our attention that a loud party is being held, we reserve the right to evict immediately with no refund of monies paid.
3. Should immediate eviction not be possible, private security guard/s may be commissioned by us to ensure the above noise conditions are adhered to. The cost of this will be for your account. Eviction will then take place the next day.

Overall description Luxurious 4-5 Bedroom Villa Close to Tourist Hub of Cape Town!
(Please note that there are currently some construction work diagonally opposite and 2 houses down from this villa which may result in the occasional noise during the week between the hours of 8am and 5pm. No work allowed on week-ends.)
Situated in the exclusive and sheltered Fresnaye area, this beautiful and spacious 2 story villa sleeps eight to ten guests in four en-suite bedrooms.
As you walk up the entrance steps, the scent of lavender bushes greet you. This villa is designed for privacy and relaxation.
The living area flows out to the wide patio. Here a shallow, salt water splash pool(which can be heated upon request) is perfectly placed to enjoy the beautiful views of the Atlantic Ocean. Sun-loungers around the pool entice you to enjoy the sunshine. To one side of the covered patio is an outdoor sofa and chairs and to the other side is an outdoor dining table next to the gas Weber barbecue.
There is plenty of room to relax inside on cooler, winter evenings. The elegant living room has a large wood burning fireplace for romantic evenings. The 8 seater dining table, which can be converted into 12-seater, is the perfect setting for gourmet dinners. The mini Hi-Fi has a plug in for iPods.
At the rear of the living area is the ultra modern kitchen and scullery area. The well equipped kitchen has a gas stove, 2 electric ovens, double fridge- freezer, microwave, coffee machine, electric juicer and more. The separate scullery area has a dishwasher, tumble drier and washing machine.
Off the living area is a study with two desks, fax/copier and wireless internet. The study opens on to a ‘zen’ garden with a water feature, located in the heart of the villa, where you can sit and meditate on a built-in couch with deep cushions.
Next to the study, a private cinema room has a big screen satellite TV with overhead projector and surround sound where you can enjoy favourite films. The cinema room can be converted to a 5th bedroom with a queen size bed upon request.
The four bedrooms have TVs, heater/air conditioners and en suite bathrooms. The master bedroom is very spacious and opens on to a large balcony with a romantic couch for enjoying the sun and the unrestricted sea views. The King sized bed is extra length.
The main en-suite bathroom has panoramic views from the bath. The big shower with built-in seating doubles as a steam-room. There is a separate walk-in closet with ample cupboards and an electronic safe between bathroom and bedroom. A hairdryer is provided.
The second bedroom has a queen sized, extra length bed, the third bedroom has 2 single beds (which can be made-up as a king size bed upon request) and the fourth bedroom has a King size bed. The en-suite bathrooms each have a separate shower and bath.
The villa is ideally located as Fresnaye is sheltered from the prevailing winds. It is a short distance to the golden beaches at Clifton or the Seapoint seafront where you can find plenty of shops and restaurants.
The villa has an alarm system linked to armed response. There is a digital safe for small valuables. Up to 20 gig data is included with the internet access. The villa is fully equipped for self catering including crockery, cutlery, towels, beach towels and crisp white percale linen.
There is a full time housekeeper from Monday to Friday excluding public holidays.
