It is a condition of occupancy that the owner, Body Corporate, Home Owner’s Association, or Atlantic Marina will not be held responsible for loss or damage of any property brought onto the premises, whether arising from the negligence (gross or otherwise), or wrongful act of any person in the employment of the owner, Body Corporate, Home Owners Association, or Atlantic Marina. An electronic safe is provided for your valuables.
Number of Overnight Occupants
Overnight occupation is strictly according to the number of persons as per the reservation document.
Number of occupants guideline (2 per bedroom) :-
Studio/One Bedroom - 2 people
2 Bedroom Apartments - 4 people
3 Bedroom Apartments - 6 people
No more than 4 visitors are permitted at any one time without prior arrangements with Atlantic Marina.
Visitors should vacate the apartment and premises by midnight.
Please park in the allocated bay, with the same number as your apartment. Visitor’s bays are also provided.
Please note: The speed limit on the estate is 20km/hour
Parties / Social Gatherings
No parties or social gatherings are allowed with more than 4 visitors at a time.
Security has been instructed to refuse entry to visitors who are clearly intoxicated
Behaviour and Noise
The client/tenant is responsible for the correct and decent behaviour of all occupants. Should the client/tenant and/or his visitors behave in such a manner which is not acceptable by civilized standards, the client/tenant and his guest will be evicted from the apartment and the Estate.
No loud music, shouting/using foul language (to staff of Atlantic Marina or the Estate Staff) or any anti-social behaviour will be tolerated. Should the client/tenant and or/his guests not adhere to requests to control their behaviour, Atlantic Marina and/or the Estate Security will switch off the electricity to the apartment. Please respect the quiet times between 23h00 and 07h00.
Please note: Should you get evicted by Atlantic Marina and/or the Estate Management, there will be no refund on your booking. Atlantic Marina will not be held responsible or liable to find you alternative accommodation.
No braai’s/BBQ’s are allowed on the premises.
Swimming pools are there for the enjoyment of all guests. Please exercise considerate behaviour.
Please note: Under no circumstances may children under the age of 12 be left unsupervised by an adult anywhere on the Estate, and most especially not at the pool.
Garbage will be collected daily in your apartment by housekeeping staff. Please do not place garbage in the foyer or passage outside your front door.
If you need throw something away urgently, there are refuse rooms in the basement level/car park.
Trolleys are not allowed in the lobbies or the apartment.
Children are to be under adult supervision at all times. They are not allowed to play in passages, lobbies, lifts, driveways, or the basement parking area.
Firearms are to be declared at check in.
Monday to Friday: Daily Service
Saturday, Sunday & Public Holidays: Service on request at an additional charge
We offer a laundry service Monday – Friday. Please advise the Operations person on staff, or our offices that you wish for laundry to be done in your apartment. Apartments are also equipped with washing machines and tumble dryers. Please refrain from hanging any washing outside on the balconies.

Check In: 2pm Check Out: 11am
Should you wish to check out after the time above, please arrange with the Operations person on duty, or our offices. This will be charged for and is subject to availability.
Please advise our Operations staff of your departure time, if before 11am. They will collect your keys and access disks on check out. Should your check out time be within the hours of 12am – 7am, please drop your keys and access disks at security, ensuring to tell them that it must be put in the Atlantic Marina drop box.
Lost keys and access disks will be charged at R 200 and R 100 respectively.
Water and Electricity Usage
Please use water and electricity in a responsible manner. South Africa is experiencing a shortage of both.
These rules have been set by the Estate Management, Body Corporate’s and Home Owners Association of the V&A Marina Residential.
It is the duty of Atlantic Marina to inform you of the rules to ensure a wonderful environment for everyone to enjoy.

ACCOUNTS & PAYMENTS
A 50% deposit is required to confirm all reservations.
All balances are due at least 14 days prior to arrival.
Non-payment of any balance constitutes a cancellation.
Rates are subject to change without prior notice.
Rates quoted are subject to availability.
All extra service costs are to be settled prior to departure.
Cancellations less than 14 days before arrival forfeits the full rental.
Cancellations less than 28 days before arrival forfeits the full deposit.
INSPECTIONS AND VIEWINGS
Atlantic Marina shall have the right to inspect the interior of the Premises, by reasonable prior notice.
The Guest shall permit viewings of the Premises at all reasonable times and by reasonable prior notice.
COMPLIANCE WITH APPLICABLE LAW
The Guest shall not commit or allow on the Premises any act in contravention of any applicable laws or regulations.
The Guest shall not do anything that may void the property owner’s insurance in respect of the Premises and hereby indemnifies Atlantic Marina and the property owner against any and all such uninsured risks and damages howsoever caused during the Guest’s occupancy of the Premises.
The Guest undertakes not to cause any nuisance to neighbouring occupants and agrees that immediate eviction from the Premises may be otherwise enforced by the owner/agent at the Guest’s expense.
BREACH, APPLICABLE LAW, JURISDICTION AND LEGAL COSTS
In the event of the Guest failing to pay the rental due hereunder on the due date thereof, or commit a breach of any of these terms and conditions, Atlantic Marina shall have the right to give written notice to The Client requiring him to pay the rental or remedy such breach, as the case may be, within a reasonable time, where after Atlantic Marina shall have the right to terminate the occupancy of the Premises by the Guest and to retake possession of the Premises without prejudice to any claim which Atlantic Marina or the property owner may have for rent and/or damages The Guest hereby consents to the jurisdiction of the Magistrates Court of Cape Town. The laws of South Africa govern this occupancy agreement. The Guest shall be liable for Atlantic Marina’s legal costs on a scale as between attorney and own client in the event that Atlantic Marina has to take legal action to enforce the Guest’s obligations hereunder.
The Guest hereby undertakes and agrees that the Premises shall be occupied solely and exclusively as a self-catering holiday residence and that no business or profession shall be conducted therein. The Guest shall not allow the Premises or any portion thereof to be used or occupied by any person other than the persons named on this form.
The Guest agrees that he will be liable for all damage to any part of the Premises or its contents howsoever caused during this occupancy.
VACATION OF PREMISES
The Guest undertakes that on the termination of his occupancy, he will vacate the Premises and deliver it to Atlantic Marina in a proper condition and in the same good order as received at the commencement of his occupancy.
LIMITATION OF ATLANTIC MARINA’S LIABILITY
Atlantic Marina shall not be liable for any injury, damages or inconvenience to the Guest, members of his family, his employees, servants or visitors howsoever caused.
OCCUPANCY DURING DISPUTE
In the event of Atlantic Marina canceling this lease and the Guest disputing Atlantic Marina’s right to cancel and remaining in occupation of the Premises, the Guest shall, pending settlement of such dispute either by negotiation or litigation continue to pay rental provided for in this occupancy agreement and Atlantic Marina shall be entitled to accept and recover such payments and the acceptance thereof shall be without prejudice to and shall not in any way whatsoever effect Atlantic Marina’s claim for cancellation then in dispute.
PARTIES / CELEBRATIONS
No parties or celebrations are permitted on, within or surrounding the Premises without Atlantic Marina’s prior written consent.
SALE OF PROPERTY
The Guest agrees that Atlantic Marina CC is a managing agent, and represents the owner of the Premises. In the event of the Premises being sold before the Guest is to occupy the property, or while the Guest is in occupation of the Premises, Atlantic Marina will be entitled to terminate the Guest’s occupancy provided that the Guest shall be entitled to a pro-rata refund of rental paid.
