    The SpaceWe have a four bedroom fully furnished house available for the 2011 Summer Del Mar horse racing season on a weekly rental basis. Our house has 4 bedrooms and 3 bathrooms and is a few blocks from the Del Mar beach. It is walking distance to the Del Mar Race Track as well as the Del Mar village. Our house is available on a weekly rental basis from mid-June 2011 through August 2011. No pets allowed. Cleaning fees and rental deposit are additional.

    The SpaceThis is the happiest home! The entire living space (dining room, kitchen, living room) is open and light pours through the floor to ceiling windows. The furnishings are mostly mid century modern pieces. There is a patio in front with grill, there is a front and back deck with lounging area, and a roof top deck with lounge chairs, dining area and OCEAN VIEWS! All patio and deck spaces are private to the unit. If you stay, you must enjoy the sunset up there. There is also a back yard with hot tub for your enjoyment. The top floor unit of the duplex has two bedrooms. The entire unit has gorgeous limestone tiling (perfect for sandy beach feet)! One bedroom has a king bed. The other bedroom has a queen bed. The kitchen is fully stocked for your enjoyment. The best part about this house is the location. You are one block from the best beach in Del Mar. You are also only 4-5 blocks from downtown Del Mar and Powerhouse Park. I do this walk daily! You have an array of restaurants to choose from in Del Mar. You are also within walking distance to the Del Mar fairgrounds and the beautiful Cedros Avenue in Solana Beach. Check out the concert schedule at Belly Up while you are staying here.     The SpaceWe are located in the Del Mar Beach Colony. Our 2 bedroom, 2 full bathroom condo is furnished with everything you need to be comfortable during your stay. The kitchen is equipped with new stainless steel appliances and granite counter tops. All dishes and kitchen wares are provided should you chose to make a home-cooked meal. Curl up on the couch in the the living room and relax with a movie or use the free wifi. The master suite has a very cozy queen-sized bed. The second bedroom has a full/twin bunk bed. All linens and bath towels are provided for your convenience. Guest AccessYou must book the unit to find out about access information. You will have access to the carport locker that has beach umbrellas, towels, a cooler, and beach chairs. You may use the outside shower to rinse off after a day on the sand. We are located on the second floor, accessible by stairs and elevator. If you need to do laundry, washers and driers are located just downstairs. You will need quarters to operate them. Interaction with GuestsWe want our guests to feel welcome and comfortable. Please contact me with concerns or questions. The NeighborhoodSimply walk across the street down one short block and sink your toes into the sand and take in the sunshine. The quaint shops and restaurants of the Del Mar village are a short walk down the beach. On the way, check out Powerhouse Park overlooking the ocean or get a treatment at the L'Auberge Spa. If you are here during the race season or while the fair is in town, the fairgrounds are less than a mile east of the condo. Getting AroundYou have 1 assigned covered parking spot or access to 4 community spots. Of course, there is plenty of street parking out front. Solana Beach Coaster Station is about 2 miles north. Bus stops are close by along Camino Del Mar. From San Diego airport, drive north on Hwy 5, exit Via De La Valle and go west toward the ocean. Turn left on Camino Del Mar, pass the estuary. The property will be on the left. Other Things to NoteLegoland, Wild Animal Park, Seaworld and the San Diego Zoo are all within a 40 min drive. The San Diego County Fairgrounds, Del Mar Race Track, and the Del Mar village are within walking distance.

    The SpaceThanks for checking out my Kid and Pet friendly, 3 bedroom beach rental. This duplex is a 1 min walk to one of the best beaches in San Diego, 25th Street in Del Mar! There is a crosswalk and BOOM, you are at a life guard tower, complete with showers and bathrooms! Our duplex has a Master bedroom and flat screen TV on the first floor. There is also a full bathroom on the fist level. Up a set of stairs are the two other bedrooms. The first has a queen bed, the second has a full bed with a twin bed on top (bunk beds). There is another twin that slides out from under the bunks. We also have a pack and play in the closet for little ones that visit. On that same floor is a second full bathroom. The kitchen, living room, and dinning room are all also on the second floor. The living room has a fireplace, a flat screen TV mounted to the wall, and two pull out sofas. There is a 2 car garage on the first level, so parking WILL NEVER BE AN ISSUE, yay! If you are staying in the Beach Colony, you NEED a garage or you will drive around for hours looking for a place to park. Ours has the parking :) You can walk to The Brigantine, Jakes, Poseidon, 15th Street, and Dog Beach from this beach house too. We also have a fenced outdoor patio, complete with 2 tables and chairs, a sitting area, and a BBQ. Come stay, you won't want to go home :) Guest AccessBoogie Boards, foam surf boards, sand toys, beach chairs, a 2 car garage (HUGE bonus!), wifi, kids indoor toys, etc! Interaction with GuestsWe have a lockbox at the house, you come and go as you please.... The NeighborhoodThis neighborhood is sooooo friendly, everyone walks their dogs and says hello. There are plenty of food options, so you won't use the car often. Getting AroundIf you plan to explore San Diego and visit places like LEGOLAND or The Zoo, you will need a car. Other Things to Note1. No parties please, and please keep the noise down after 9pm and until 9am. If there is a party, you forfeit your entire deposit. If the police are called to the house because of noise abatement or partying, you will immediately be asked to leave and will lose all rental money & deposit. 2. Please clean your dishes before checkout, otherwise our cleaners will charge you $1/dish. This amount will come out of your deposit. 3. This is a NON SMOKING unit, and Del Mar is a No Smoking city. 4. CANCELLATIONS – A sixty (60) day notice is required for cancellation. Cancellations that are made more than sixty (60) days prior to the arrival date will incur no penalty, aside from a $250 restocking fee. Cancellations or changes that result in a shortened stay, that are made within 60 days of the arrival date, forfeit the full advance payment (not including deposit and cleaning fee).             The SpaceOur home sits like a bird house perched high among the trees on the hill above the small town of Del Mar and the ocean. It is about a 10 minute walk to the bluffs overlooking the beach or a 15-20 minute walk to a lifeguarded beach with amenities. The house is an architectural gem, a contemporary version in glass and wood of the classic mid-century modern style, originally built in 1959 and recently 100% remodeled. Two nine-foot sliding glass doors open up to living patios facing the ocean; in all there's a remarkable 180 degree view of the Pacific and La Jolla. Set in a garden, the house is an open air living environment featuring at its core a large living room and kitchen in Pacific Rim eclectic style. A master bedroom, also facing the ocean, has an adjoining generous bath. In the TV room/Den there is a Roche Dubois queen size convertible sofa bed that is comfortable for guests; a second bath with large shower adjoins the den. The kitchen features contemporary appliances and a large L-shaped island. Electronic amenities include office and wifi internet connections, two flat screen high definition TVs with bluray DVD player and DVR cable service, ipod /stereo/cd player /tuner with sound throughout the house. Outdoor furniture and grill; outdoor shower and beach equipment all included. Driveway parking space for two cars away from the street included. The house is nestled in a quiet wooded neighborhood in the hills above the Pacific with lots of open space, walking trails, friendly neighbors. The village of Del Mar is accessible by walking or driving 3 - 5 minutes. Del Mar features top-quality restaurants, shops, bookstore, spa, Saturday farmers market, beach, bike trails and parks. Torrey Pines State Park and Beach are 3 miles from house. Del Mar Race Track (horses) is a 10 minute drive or 20-minute walk. La Jolla and San Diego are 20-25 minutes from house with world recognized theater, museums, water sports, fishing, dining, parks. Mexico is 45 minutes down the road with two available border crossings. We renovated the house as a refuge for adults who like a peaceful, comfortable, and above-all beautiful retreat to enjoy the ocean, the beach, read, watch movies, write, walk, cook, enjoy the sunsets, the ocean, good food, good sleeping and soaking in the tub that looks out to a private garden. It is a great place to entertain friends too. It isn't easy to find a vacation rental that doesn't feel stripped down, institutional, grubby like a hotel room. As our family's second home, we take excellent care of the place . We don't "put things away" when we have guests: we offer it as we would to friends to enjoy it as we do. The garden is simple and lovely. We have a gardener and house cleaner who come once a week. There is coastal bus service a five minute walk away. Train service, both commuter to San Diego or Amtrak for longer trips, can be accessed in Solana Beach, the next town north which is about a 10 minute drive with free parking available. A train trip to Los Angeles or up the coast is easily available. We have specified no pets or children because the house sits on a bluff with no fencing and the interior isn't child proofed. We would be open to negotiating this rule if your children are not yet walking or if you have a small, housebroken dog who won't run away. There aren't many places in Southern California that afford the climate, the ocean, the amenities of a small California beach town while feeling like they are away from it all, offering beauty, quiet and entertainment in the same town. There are also two large public parks right on the beach that are easy 5-10m walks away (Seagrove park and Powerhouse park). The restaurants nearby offer a variety of cuisines for a range of prices, from simple but hearty sandwiches at Board & Brew to a nice candlelit meal with an ocean view at Sbicca or Pacifica. If you like to cook, there is a great farmer's market two blocks from the unit that takes place every Saturday perfect for picking up groceries and local pies from Julian! Getting AroundThe 101 bus stop is about a 15m walk from the unit, which can take you easily southwards UCSD, La Jolla, Pacific Beach, as well as northbound towards Encinitas and Solana Beach. The shops and restaurants nearby are all within walking distance. Other Things to NotePhotos shown are for a similar unit in the same complex; I also have a second listing with photos of a second unit that gives you a general sense for the style of the units in the complex. The unit available for rental is actually slightly larger than the one photographed. Following some guest feedback: as a full disclaimer, the sofa bed in the unit is not very comfortable as it is on the older end and very creaky (I have slept on it myself and have been fine, but I am also a very heavy sleeper). The front desk can provide mattress pads/additional bedding to try to increase your comfort, but please be aware when booking. The complex is equipped with wifi but the signal is strongest by the front desk/common lounge area, and may be spotty in the actual unit.

This is the penthouse unit, so the ceilings are super tall. The condo is VERY light & bright. All beach/ocean décor. The kitchen, living room, dinning room all face the ocean. We have a flat screen TV in the living room and WiFi. The master bedroom has a King bed and a walk in closet, also windows that face the ocean. The second bedroom has a twin over full set of bunk beds, and a TV. The bathroom again faces the ocean, INCREDIBLE view! We have a shower/tub. There is one set of stairs leading to and from the condo. We overlook the crystal clear pool. Laundry onsite and you condo comes with a covered and marked spot in the carport. I do live a mile away in case you need anything :) The NeighborhoodDel Mar is the safest beach community in San Diego. We also have the best food in town! The Del Mar race track is 2 miles away. Quiet hours from 9pm-9am out of respect for neighbors please. If there is a party, you forfeit your entire deposit. If the police are called to the house because of noise abatement or partying, you will immediately be asked to leave and will lose all rental money & deposit. 2. Please clean your dishes before checkout, otherwise our cleaners will charge you $1/dish. This amount will come out of your deposit. 3. This is a NON SMOKING unit. 4. We are a quick one block walk, to flat sandy beach access (just 7 houses to the beach!). Our home has 4 bedrooms and 2 baths (and an outdoor shower, so 3 showers). There are no stairs at our home, it is all on one level. Great for elders and kids! We are light and bright and have an ocean feel inside, with lots of beach art. We can sleep up to 12 people and we have a 2 car garage (essential no matter where you stay in Del Mar, parking is terrible!). We also have 3 driveway parking spots, so 5 spots onsite for cars. We are EXTREMELY kid-friendly! We have a baby pack and play (portable crib), high chair, indoor toys, sand toys, kids books, boogie boards, bunk beds, and a stool. We also have adult gear: 3 beach cruiser bikes, black out shades in all bedrooms, down duvets on all beds, and foam surf boards. We also allow furry friends at our fully fenced in home. We have a recently remodeled kitchen with all the cooking gear, ready for you to make your families meals in. Our fenced in yard has a great outdoor entertaining area complete with a built in BBQ and a big outdoor table. There is plenty of space for your kids to play outside in the fully fenced in yard. We have a few outdoor ride on toys for the kids enjoyment also. Lastly, we have all the beach gear essential for feeling like a local: foam surf boards, a wagon to pull gear, chairs, sand toys, boogie boards, and 3 beach cruiser bikes. If the police are called to the house because of noise abatement or partying, you will immediately be asked to leave and will lose all rental money & deposit. 2. Please clean your dishes before checkout, otherwise our cleaners will charge you $1/dish. This amount will come out of your deposit. 3. This is a NON SMOKING unit, and Del Mar is a No Smoking city. 4. CANCELLATIONS – A sixty (60) day notice is required for cancellation. Cancellations that are made more than sixty (60) days prior to the arrival date will incur no penalty, aside from a $250 restocking fee. Cancellations or changes that result in a shortened stay, that are made within 60 days of the arrival date, forfeit the full advance payment (not including deposit and cleaning fee). Other Things to NoteYou will be required to sign the below rental agreement: SHORT TERM RENTAL AGREEMENT This Short Term Rental Agreement (the “Agreement”) is made by and between The Borts Family Trust (“Landlord”) and Tenant as of the date set forth on the signature page of this Agreement. The parties agree as follows: PREMISES. In consideration of the Lease Payment, Landlord leases to Tenant the Premises and the Furnishings hereinafter set forth (collectively the “Premises”) located on Santa Fe Avenue, Del Mar, CA 92014. TERM. The lease term will begin at 3:00 PM on the date of your Airbnb reservation and will terminate on the last day of your Airbnb reservation at 11:00 AM (the “Lease Term”). Exceptions to check in and check out times must be pre-approved by Landlord. When given advanced notice, Landlord will attempt to accommodate exceptions. Non-approved exceptions will result in a charge of (5%) of the nightly rate for every half-hour before 3:00 pm or late departure after 11:00 am. LEASE PAYMENT. Tenant shall pay to Landlord as rent the sums payable pursuant to the terms of the Airbnb reservation (the “Lease Payment”). Upon receipt and execution of the Lease, Tenant shall deliver to Landlord the executed Lease and make payment pursuant to the terms on Airbnb. MAXIMUM OCCUPANCY: The maximum occupancy (adults and children) of the Property is 10 persons at anytime. No more than 10 guests shall be in the home at any one time. If at any time the Premises is occupied by more than the Maximum Occupancy, the Landlord shall have the option to declare Tenant to be in breach of this Agreement, and Landlord shall be entitled to require all persons occupying the Premises to immediately vacate the Premises or take measures to have all persons removed from Premises and Tenant shall automatically forfeit the right to the return of any unused Rental Fees and/or shall forfeit the Security deposit, at Landlord’s discretion. POSSESSION. Tenant shall be entitled to possession on the first day of the Lease Term, and shall yield possession to Landlord on the last day of the Lease Term, unless otherwise agreed by both parties in writing prior to the expiration of the Lease Term. At the expiration of the Lease Term, Tenant shall return copies of all keys or opening devices to the Premises; remove its goods and effects and peaceably; vacate any/all parking and/or storage space, and return the Premises to Landlord in as good a condition as when delivered to Tenant, ordinary wear and tear excepted. Unless otherwise provided for in the Lease, in the event of any damage to the Premises, Tenant shall be liable and responsible for all costs and expenses necessary, within the sole judgment and absolute discretion of Landlord, to remedy such damage. Landlord shall notify Tenant in writing of the amount of the costs and expenses to remedy such damage, together with an accounting thereof, and Tenant shall forthwith remit to Landlord such amount. FURNISHINGS. Landlord will provide the following furnishings: washer, dryer, refrigerator, range, BBQ, dishwasher, TV, beds, dressers, couches, chairs, furniture, vacuum, kitchenwares, kitchen appliances and tables in addition to lamps, linens, towels, housewares and beach items. Tenant shall return all such items at the end of the Lease Term in a condition as good as existed at the beginning of the Lease Term, normal wear and tear excepted. Its agreed that stains, burn holes, ALTERATIONS: Tenant shall not paint, wallpaper, alter or redecorate, change or install locks, window coverings, wall hangings, install fixtures of any kind, install antenna or other equipment, screws, fastening devices, nails, or adhesive materials, place signs, displays, or other exhibits, on or in any portion of the premises without the written consent of the Landlord except as may be provided by law. UTILITIES AND SERVICES. Landlord shall be responsible for and pay the cost of providing water, sewer, garbage collection, electricity, TV cable/satellite, gas and wireless internet to the Premises. Landlord shall have the responsibility to maintain the Premises in good repair at all times and perform all repairs reasonably necessary to satisfy any implied warranty of habitability in addition to having the Premises professionally cleaned prior to the commencement of the Lease Term. During the Lease Term, Tenant, at its sole cost and expense, shall have the sole responsibility of keeping the Premises in a clean condition. HABITABILITY. Tenant acknowledges and agrees that the Premises and fixtures are in a reasonable and acceptable condition of habitability for their intended use, and the agreed Lease Payment is fair and reasonable. CONDITION OF PREMISES: Tenant shall upon arrival examine the premises, all furniture, furnishing, appliances, fixtures and landscaping and shall immediately report in writing, if any are not in operating condition or are in disrepair. Reporting repairs does not give Tenant the right to cancel this Agreement or receive a refund of any payments made. Tenant agrees to keep the premises and all items in good order and good condition and to immediately pay for costs to repair and/or replace any portion of the above damaged by Tenant, their guests and/or invitees, except as provided by law. At the termination of this Agreement, all of above items in this provision shall be returned to Landlord in clean and good condition except for reasonable wear and tear and the premises shall be free of all personal property and trash not belonging to Landlord. It is agreed that all dirt, holes, tears, burns, and stains of any size or amount in the carpets, bedding, drapes, walls, fixtures, and/or any other part of the premises, do not constitute reasonable wear and tear. MAINTENANCE: Tenant shall properly use, operate and safeguard the Premises including, if applicable, any landscaping, furniture, furnishing, appliances, and all mechanical, electrical, gas and plumbing fixtures, and keep them clean and sanitary. Tenant shall immediately notify Landlord of any problem, malfunction or damage. Tenant shall pay for all repairs or replacements cause by Tenant, guests and licensees of Tenant, excluding ordinary wear and tear. Tenant shall pay for all damage to the Premises as a result of failure to report a problem, malfunction or damage in a timely manner. Tenant shall pay for repair of drain blockages or stoppages, unless caused by defective plumbing parts or tree roots invading sewer lines. INSPECTION/REPAIR. Landlord or Landlord’s agents may enter the Premises upon reasonable notice to Tenant in order to inspect the Premises, to make necessary repairs, alterations or improvements, or to supply necessary or agreed to services; to verify that occupant has complied with the terms of this agreement; or to show the Premises to prospective purchasers, tenants or appraisers; or in case of an emergency. USE OF PREMISES/ABSENCES. Tenant shall occupy and use the Premises as a dwelling unit and shall notify Landlord of any anticipated extended absence from the Premises not later than the first day of the extended absence. Tenant shall not make any alterations to the Premises or to any fixtures or furnishings in or on the Premises. LAWS AND RENTAL RULES AND REGULATIONS: Tenant agrees to abide by the Rental Rules attached as Exhibit “A” at all times while on the Premises and shall cause all members of the rental party and anyone else Tenant permits on the Premises to so abide. Tenant shall comply with all statutes, ordinances and requirements of all municipal, state and federal laws regarding the Property, including the use, possession, production or sale of illegal drugs. If Tenant and/or its guests and invitees do not abide by the aforementioned laws, Rental Rules and/or regulations, they are in breach of this Agreement and may be required to immediately leave or be removed from the Premises. Tenant forfeits its right to return of any security deposit and/or unused rent. PETS. Pets shall not be allowed, unless previously consented to in writing by Landlord, which consent shall be within the sole and absolute discretion of the Landlord. If the Tenant violates this no-pet policy, Tenant will be required to immediately vacate the Premises or shall be removed therefrom. Tenant forfeits the right of the return of any unused Rental Fees. Tenants violating this no-pet policy will forfeit a minimum cleaning fee of $500 from the security deposit and shall be charged for all costs incurred by Landlord to repair any damages to the Premises caused by pets. In the event Landlord consents in writing, Tenant shall be responsible for any damage incurred as a result of any pet and agrees to return the Premises to the Landlord at the end of the Lease Term in the same exact condition as the Premises were delivered to the Tenant at the commencement of the Lease Term. In the event of any damage to the Premises, Tenant shall be liable and responsible for all costs and expenses necessary, within the sole judgment and absolute discretion of Landlord, to remedy such damage. Landlord shall notify Tenant in writing of the amount of the costs and expenses to remedy such damage, together with an accounting thereof, and Tenant shall forthwith remit to Landlord such amount. DANGEROUS MATERIALS. Tenant shall not keep or have on the Premises any article or thing of a dangerous, flammable, or explosive character that might substantially increase the danger of fire on the Premises, or that might be considered hazardous by a responsible insurance company, unless the prior written consent of Landlord is obtained and proof of adequate insurance protection is provided by Tenant to Landlord. SMOKE-FREE PREMISES. Tenant understands and agrees that there shall not be any smoking of any kind on the Premises and further agrees to keep and maintain the Premises smoke-free. In the event there is evidence that smoking has occurred on the Premises during the Lease Term (including but not limited to stains, burns, odor or debris), Tenant shall be liable and responsible for all costs and expenses necessary, within the sole judgment and absolute discretion of Landlord, to remedy the matter. Tenant violating this no-smoking policy will forfeit a minimum additional cleaning fee of $500 from the security deposit. Landlord shall notify Tenant in writing of the amount of costs and expenses incurred to remedy the matter, together with an accounting thereof, and Tenant shall forthwith remit to Landlord such amount. If Tenant violates the no-smoking policy, Tenant may be required to immediately vacate the Premises, or may be removed, in which case the Tenant forfeits all rights to the return of any unused Rental Fees. PROPERTY INSURANCE. Landlord and Tenant shall each be responsible to maintain appropriate insurance for their respective interests in the Premises and property located on the Premises. Landlord recommends that Tenant carry or obtain insurance to protect Tenant, guests and licensees and their personal property from any loss or damage. OWNER INSURANCE: Tenant acknowledges that Landlord’s insurance does not cover any of Tenant’s or Tenant’s invitees’ personal property, including vehicles, against loss or damage due to fire, theft, vandalism, rain, water, criminal or negligent acts of others, or any other cause. Owner does not insure against personal injury to Tenant, guests or licensees due to any reason other than the condition of the Premises. INDEMNITY REGARDING USE OF PREMISES. Tenant will indemnify, defend and hold harmless Landlord, owner of the Premises and their agents, representatives, attorneys and assignees (“Released Parties”) from all claims, disputes, liabilities, demands, causes of action, litigation, judgments, costs, expenses, and attorneys’ fees, arising out of, related to or any manner whatsoever connected to Tenant’s use or occupancy of the Premises while in Tenant’s care, custody and control, including but not limited to injury to Tenant, Tenant’s guests, invitees and licensees, and damage to their personal property, except for any negligence by Released Parties. Released Parties shall not be liable for any damage or injury to Tenant, or any other person, or to any property, occurring on the Premises. Tenant agrees to waive and release the Released Parties from any and all liability for costs, expenses or damages due to loss of property or for personal injuries or death (“Claims”) which may occur to Tenant and/or Tenant’s guests, invitees and licensees while on or about the Premises, except for injury or damage caused by the negligence or willful misconduct of the Released Parties. Tenant hereby assumes the risk of a Claim while using the Premises. This waiver and release is intended to be a full and complete waiver and release of the Released Parties from any and all present or future Claims (known or unknown), except for injury or damage caused by the negligence or willful misconduct of the Released Parties. HOLDOVER. If, with the prior written consent of Landlord, which consent shall be within the sole and absolute discretion of Landlord, Tenant maintains possession of the Premises for any period after the expiration of the Lease Term (“Holdover Period”), Tenant shall pay a charge of 1 and 1/2 times the daily prorated rate plus any additional damages incurred including, but not limited to the cost of alternative housing for guests displaced by Guest’s holding over. Such holdover shall constitute a day to day extension of the Lease. ASSIGNABILITY/SUBLETTING. Tenant shall not assign or sublease any interest in the Premises, nor assign, mortgage or pledge the Lease, without the prior written consent of Landlord, which consent shall be within the sole and absolute discretion of Landlord. DEFAULTS. Tenant shall be in default under the Lease if Tenant fails to fulfill any obligation or term by which Tenant is bound under the Lease. Subject to any governing provisions of law to the contrary, if Tenant fails to cure any financial obligation within 5 days (or any other obligation within 10 days) after written notice of such default is provided by Landlord to Tenant, Landlord may elect to cure such default and the cost of such action shall be added to Tenant’s obligations under the Lease and Tenant shall immediately pay and remit such cost to Landlord. All sums of money or charges required to be paid by Tenant under the Lease shall be additional rent, whether or not such sums or charges are designated as “additional rent.” The rights provided by this paragraph are cumulative in nature and are in addition to and not in lieu of any other rights afforded Landlord at law or in equity. CANCELLATION POLICY: Upon receipt by Landlord of the Lease Payment, in the event that Tenant cancels the Lease, Tenant acknowledges, understands and agrees that reservation, deposit and all rent paid will be refunded only pursuant to the terms of Airbnb. There are no exceptions. The security deposit will be returned in full 14 days after departure provided no outstanding expenses have been incurred. REFUND POLICY: Landlord cannot guarantee against mechanical failure of heating, air conditioning, TV, Internet or Cable receivers, or any other appliance, large or small. Please report any inoperative equipment to Landlord immediately who will make every reasonable effort to have the repairs done quickly and efficiently. NO REFUNDS OR RENT REDUCTIONS will be made due to failure of appliances or equipment. NO REFUNDS OR RENT REDUCTIONS will be made for early departure (fewer days than reserved) or delayed arrivals (checking in later than 4pm on arrival date). Landlord shall not be liable for events beyond their control which may interfere with Tenant’s occupancy, including but not limited to Acts of God, acts of governmental agencies, fire, strikes, war, inclement weather or noise from nearby construction. NO REFUND OR RENT REDUCTIONS will be offered due to these circumstances. UNAVAILABILITY: If for any reason beyond the control of the Landlord the Premises is not available, Landlord may cancel this agreement and refund in full to Tenant all payments made. NOTICE. Notices under the Lease shall not be deemed valid unless given or served in writing by email provided below. Such addresses may be changed from time to time by either party by providing notice as set forth below. Notices mailed in accordance with these provisions shall be deemed received on the third calendar day after sending. There are no other promises, conditions, understandings or other agreements, whether oral or written, relating to the subject matter of the Lease. The Lease may be modified or amended in writing, if the party obligated under the amendment signs the modification or amendment. SEVERABILITY. If any portion of the Lease shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of the Lease is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited. CUMULATIVE RIGHTS. The rights of the parties under the Lease are cumulative, and shall not be construed as exclusive unless otherwise required by law. WAIVER. The failure of either party to enforce any provisions of the Lease shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with each and every term and provision of the Lease. BINDING EFFECT. The provisions of the Lease shall be binding upon and inure to the benefit of both parties and their respective legal representatives, successors and assigns, subject to the provisions herein contained pertaining to ASSIGNABILITY/SUBLETTING. The Landlord are not responsible for the loss of personal belongings or valuables of the Guest. By accepting this reservation, it is agreed that all Guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise, whether caused by Homeowners negligence or otherwise. 4. Keep the property and all furnishings in good order or be charged a replacement fee subject to normal wear and tear. 5. Only use appliances for their intended use. 6. Pets are permitted only with prior approval and the Pet Addendum must be completed.  7. This is a quiet residential neighborhood where neighbors typically keep their windows open. Please be aware of the volume of your group and be respectful of the neighbors. 8. Absolutely no parties or functions at which more persons are present than permitted by the Maximum Occupancy for the Premises (“Gatherings”) are permitted without clear written approval from the Landlord. In order to host a Gathering, the Tenant must sign a Special Events Agreement. Tenants shall be quiet and peaceful, so as to respect and not to disturb other residents of the neighborhood. 9. Parking is limited to the driveway.  Parking on the street is permitted, but spaces fill up quickly during weekends and holidays. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner. 10. There is no daily housekeeping service unless you wish to arrange it with the Landlord for an additional fee. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. Any beach towels taken from the unit to the beach must be returned to the unit to avoid being charged a replacement fee. 11. The fireplace is a gas log fireplace. Please do not throw any paper or other combustible materials in the fireplace. Please ensure the flue is open and remains open during fireplace operation. Please ensure you turn the gas off after use. Landlord will not be responsible for damage or injury caused to Tenant or their invitees resulting from improper use to the fireplace. 12. Do not flush anything other than toilet paper down the toilet. No feminine products or baby wipes should be flushed at anytime. If it is found that feminine products or baby wipes have been flushed you could be charged the cost of plumbing repairs if required. 13. Please lock all doors when not on the Premises. 14. No refunds will be given for storms or on account of bad weather. 15. CHECK OUT POLICY (Please follow the Check Out Checklist which is provided in the Guest Binder, which is on the dining table). Please have the house as clean as possible, clear out the fridge, run the dishwasher and remove any trash to the appropriate receptacles outside. Trash is collected on Monday. Anything that does not fit into the trash receptacles will need to be taken to a local dumping station. Please pull off all used sheets and towels and leave them at the floor of the bed. (Please leave duvets and shams as is) All doors should be locked, windows closed and air conditioning units off. I will contact you regarding how to return the key.

The NeighborhoodThis beach colony has great beach access, no stairs or cliffs to deal with. Lifeguard at 20th street. Clean beaches, no smoking or drinking on the beach. Great surfing. Getting AroundThere are buses, and taxis, Uber. The village is walking distance, the restaurants are walking distance, a short walk. We are at 20th/19th streets and the Jakes and Poseiden restaurant, Starbucks is at 15th and Camino del Mar. Can walk to the fairgrounds & Del Mar Race Track.

                        The SpaceEnjoy the guest suite attached to a 1954 beach cottage. Private entry. Nestled in the Del Mar bluffs 2 long blocks up from the Coast Highway between 9th and 10th, easy walk to downtown Del Mar. Four-block downhill walk to the bluff above the water. 3/4 mile to main 15th St. beach access. Guest AccessPrivate entry, private living room, bedroom and bath against the bluff. No patio attached, but benches/chairs out front afford nice sunset (no ocean) view. Ocean views a-plenty just steps away, on any walk. Exclusive use driveway. Interaction with GuestsAs private as you prefer! But I'm nearby if there's a problem or question. The NeighborhoodPeaceful exclusive neighborhood. Beautiful ocean views on every walk. A few blocks away, loads of restaurants, live music 3 nights a week, but most of all, great scenery, surfing, hiking, Torrey Pines Reserve, and some decent people-watching! Getting AroundThere's bus service up and down the coast highway, which is just 2 blocks away. Other Things to NoteNo A/C (not that it's usually needed), but nice ceiling fan in sitting room, and another portable fan. Entrance is down side path and yours exclusively! Feel free to sit in front yard. A great, quiet place to sleep (or sleep in!) when you visit Del Mar. FYI, Thursday is trash day, so a little noisier than most mornings.

Guest AccessThere is a laundry room with ironing board and iron on the property and a community shower outside. beach chairs in cupboards in carport and umbrellas, boogie boards. Parking in carport is tandem. One space but two cars fit tandem, address 1935 1/2 is posted in your spot. Interaction with GuestsI will be available to help you out if you need me. The NeighborhoodThis is the Del Mar beach colony. No cliffs or stairs to access the beach. Just steps to the sand. Nice quiet community, everyone is respectful of their neighbors. Most renters are vacation renters. Great restaurants everywhere, two restaurants right on the beach a short 2 block walk. Getting AroundYou can walk to the village, to restaurants on the beach, walk to the race track/fair grounds. Short drive to everything. Bus stop at 15 St. and Camino del Mar. Train station in Solana Beach, short drive, you can walk if so inclined. Take train into San Diego and then the Red car to get around San Diego. Other Things to NoteThere is street sweeping on the 1st and 3rd Wednesday of the month. Read the posted signs.
