The SpaceThis Historic Queen Anne Victorian has original lacework & wraparound porch has 4 footprints dating back to 1839 and has been lovingly and tastefully added onto by each of the former residents preserving it's Landmark status. The woodworking is remarkable and the wood is rare and beautiful ~ including clear chestnut, blistered poplar, black walnut, cherry, white oak and heartpine ~ gracing walls, floors, ceilings, 6 fireplaces, stairs & rails. And it's for sale! Inquire within... Guest AccessThere is a separate entrance for guests. Breakfast items such as oatmeal, breakfast bars, fresh fruit, reverse osmosis water, coffee & tea will be available in the hallway between rooms. There will be a small refrigerator to store a few favorite items you might want to bring from home, plus a microwave, toaster oven & coffee maker. If you want a full cooked breakfast, that can usually be arranged: for an extra $15/person a hearty breakfast made with mostly organic ingredients will be served in your room or in the dining room downstairs. Ample notice (48hrs preferred) must be given for that option. Interaction with GuestsYour schedule will be your own while staying here. We value your privacy and also ours! :) We'll most likely be here to greet you while you check in and show you around. The NeighborhoodIt's beautiful here in WNC, no doubt about that ~ There's something about these mountains that nurtures the soul and spurs creativity. We try to never take for granted that we live in nearly the oldest mountains on the planet, a temperate rainforest & some of the most biodiverse regions on the planet are here. The house is conveniently situated in a nice agricultural neighborhood 33.3 blissful minutes from downtown Asheville ~ 45 minutes from Mount Mitchell ~ 20 minutes from Wolf Laurel Ski Resort ~ half an hour from the Appalachian Trail ~ 25 minutes from the Blue Ridge Parkway... all yielding some of the most beautiful hikes with no shortage of views or waterfalls... Many ways to satisfy your soul ~ If you're a photographer, like me ~ you will feel visually blissed constantly... And ~ on a clear night ~ you'll be able to see the Milky Way. Getting AroundThe roads are well maintained and we have never been snowed in here. You'll love the drive around our beautiful (website hidden) seems to 'do' highways right! Really lovely plantings grace the highway exit & entrance ramps. Located off Hwy 19 less than 30 minutes from Asheville in 1 direction & 35 minutes from Mt Mitchell in the other, there are beautiful drives whichever direction you go from here. We are located around 8 miles to Burnsville to the east and 8 miles to Mars Hill to the west... which are where you will find the grocery stores & gas stations live... Other Things to NoteThese mountains are home to many productive Artists & twice a year, many of them open up their studios to the public ~ Locally, it's the TRAC Studio Tour of which I participate in & join a neighboring studio about 5 minutes from the house. The Winter Tour 2015 dates are Dec 5th thru Dec 7th. It's always fun visiting the artists private space when their expecting you! Great to see the 'behind the scenes' of many of the pieces you might see in the local galleries. Great people, very good art, in a really beautiful area! We ask for a minimum 2 night stay on weekends but are flexible during the week.

The SpaceYou'll have a cozy bedroom within a 5 bedroom house at the bottom of 67 acres of gorgeous mountain land full of trails, cabins, orchards and gardens. Inside the music and art filled home you'll share a communal bathroom and kitchen with 2-5 resident artists/musicians living here. We do our best, but our house is not kept perfectly clean at all times, but it is never gross! And your bedroom will certainly be in top shape. Considering it's a farm house with dogs, cats, and a lot of folks sharing small facilities we actually do pretty well. Anyway, we hope that you're visiting us to experience the beauty and culture of a music and arts based farm and that you can be tolerant of 4 star cleanliness :) Guest AccessMake yourself at home in the kitchen, take hot showers, use the highspeed wi-fi, the cooking oil, spices, teas and foods on the communal shelf. You're encouraged to harvest and eat food fresh from the gardens, and also to join in on any communal meals. Enjoy hiking or solitude out on the gorgeous 67 acres and while you're out there harvest from the mature fruit and nut orchards. If you're interested in talking or learning about foraging and wild edible plants and mushrooms we can make that happen. Also, if guests would like to record songs in the studio that's always a pleasure as well. Interaction with GuestsThe farm is a lively place and is full interesting people, animals, plants and intsruments. Lots of art, music, and farming takes place most everyday. On average there's around 12 people here within the cabins spread across the land, all of the folks here are either artists residents, farm interns, or Air BnB guests. The variety of people and their creative talents are one of the best part of this place! Guests are welcome to join our communal dinners when taking place. The NeighborhoodWe're tucked away in a mountain valley with incredible views, but still only an 8 minute drive from town! Getting AroundBurnsville, which has grocery stores, banks, restaurants, etc, is about a 5 minute drive. Other Things to NoteWe are a dream host for people interested in or wishing to experience a community, arts and eco based lifestyle.

The SpaceThis is a real getaway place. Great for relaxing and being with the ones you love. Nearby are crafts, gifts and groceries, hiking trails and rivers, and 45 miles from Asheville with its city attractions. Interaction with GuestsYou're on your own, and I can be reached easily. The NeighborhoodPeople love the remote quiet, in a sparse community of nice folks. There are houses visible on 2 sides. One is occupied and is across a small valley and creek. The other is next door on the other side of trees, and unoccupied. My renters like the tasteful casual set up, and hanging out on the deck in the gazebo above the mountain stream. Getting AroundThere is a 2-3 hour hike up the mountain right from the cottage, or drive up a mile and save a bit of time. Burnsville is 12 miles away with stores, groceries, theater, music venue. Other Things to NoteThis is a fun rustic mountain cottage. The interior is all wood floors and walls except the master bedroom with carpet and white walls. It is a small cozy place. The well water here is different from city water. It is rich in minerals and has a high iron content. It is clean and drinkable, but we provide a jug of drinking water. Welcome to the mountains! You will be in the area of one of the country's premier artist studio tours. On special weekends, the tons of amazing artists up here open their studios to the public.     The SpaceOur farm has not and never will discriminate on the basis of race/ethnicity/culture, sexual identity, or gender identity. Your dignity and human rights will always be respected here. Come be in a non-judgmental atmosphere of relaxation and healing, surrounded by nature. The crystal clear creek and several park-like areas on property make this a great place to unwind. The nearby trails and waterfalls in national forest can be easily accessed on foot. Our farm is an agritourism destination. Guest AccessInternet is available on the property, but does not reach our campsites. You are welcome to sit on our porch and use the wifi any time you need it. A solar shower and composting toilet at the Bamboo bathroom near the main house, about 1/4 mile from the campsite, will be available for camping guests. Interaction with GuestsWe enjoy showing folks around our property as time allows. We do have many responsibilities with our farm animals, and don't always have much time to socialize. But we are social beings if time allows, and otherwise will be available if you need something so please just ask. Meals are available seasonally. If planning on having one or more meals - please let us know ahead of time, we strive to serve great food made with excellent, farm-fresh ingredients. We are experienced with accommodating a variety of food needs, including gluten-free and lactose-free diets.     The SpaceOur listing is unique because we are nestled in the Blue Ridge Mountains in a private community -Mountain Air Country Club. Our condo comfortably sleeps 4 guests, but with the couch, can sleep up to6 guests! Guest AccessGuests will have access to hiking. We are not members of teh club, so Golfing is not available. Wifi is available at the Clubhouse if you need it. Interaction with GuestsI am available any time on my cell and they can call me with any questions they have before, during or after their stay! I am not in Burnsville, but have several people I know there that I can call if I need to... The NeighborhoodIt is very quiet and (URL HIDDEN) is the most relaxing experience being in the mountains and breathing the fresh air! With the hiking trails, gorgeous golf course views, airplane landing strip at the top of the mountain, makes this a very special destination!! They should experience the hiking trails, gem mining located 15 min, from Mountain Air, skiing & horseback riding, also located only 15-20 minutes away, and the town of Burnsville, very quaint and eclectic antique stores and the people are so friendly!     The SpaceTrillium cabin is tastefully decorated with plenty of cozy cabin touches. The living room offers a wood burning fireplace with unlimited free wood and fire starters. The kitchen is equipped with everything you could possibly need to eat in every night of your stay including a propane grill, spice rack and dish cleaning supplies. All linens, bath soap and even laundry detergent is provided. Pack your suitcase as though you were traveling in an airplane and you'll be good to go! There is a bedroom and bathroom on the main floor with a queen sized bed. There is a loft bedroom with bathroom upstairs which can be set up with two twin sized beds or a single king sized bed...guest choice. The cabin can accommodate a maximum of six guests utilizing the full sized sleeper sofa. Guest AccessGuests have full access to both riverside parks and the hiking trails throughout the community of Riverwalk. The swimming pool is walking distance from the cabins and available for a small additional fee. Interaction with GuestsThe cabin owners and your hosts, Laura & Brett Watrous, live in the community of Riverwalk and make every effort to meet each of our cabin guests personally, if time allows. In the summer months, we often will organize bonfires around the Riverwalk Park fire pit as well as drop and pickup guests who wish to take lengthier river tubing rides. The NeighborhoodOur two vacation cabins, "Trillium" cabin and "Morning Glory" cabin, are both located in the quiet community of Riverwalk in the quaint little mountain town of Burnsville, NC. Burnsville is in Yancey County, home to Mt. Mitchell (highest mountain peak east of the Mississippi). Riverwalk is less than an hours drive to the city of Asheville, the scenic Blue Ridge Parkway, river rafting and tubing as well as ski resorts. Our guests can enjoy two privately owned riverside parks with a large picnic pavilion, fire pit, a swimming pool, river fishing, 200 acres with hiking trails for exploring, and more...all without ever having to get in a car! Guests are also welcome to stop by the Ewing barn & indoor riding arena area to visit with horses, a goat and a couple of donkeys. All of the farm critters, big and small, are people friendly. Paul & Judi Ewing own the barn and critters and are the developers of the Riverwalk Community. Judi is a horse enthusiast who enjoys sharing her love of horses with others. Trail riding is not available at Riverwalk but we are happy to recommend reputable stables nearby. Getting AroundThere is so much Riverwalk has to offer without ever having to get in a car. However, personal transportation is necessary to get around outside the property. Other Things to NoteNC lodging taxes are included in the rental rate, cleaning fee and pet fees.     The SpaceOn clear nights, see lots of stars. The deck has a charcoal grill, picnic table, and fire pit to enjoy during your stay. Charcoal can be purchased at the local grocery store. Firewood can be purchased for $6/bundle. This 600 sq. ft.cottage has a country setting and yet is close to shopping, farmer's market, and local happenings in the town square. Enjoy meals and sunsets on the 900 sq. ft. deck. Our area has hiking trails, waterfalls, and many local artists. When you visit, if you have a clear night, you will see lots of stars. ***Pets are welcome with a $20 pet fee that covers up to 2 pets during the length of your stay. Airbnb does not have an option to include the fee in your reservation so please leave the pet fee on the counter prior to your departure.*** Please clean up after them in the yard*** There is a pet bed available for their use! (Please don't allow them on the couch or beds.) The master bedroom has a queen bed The second bedroom has a full bed. The living room and guest room have TVs with cable. Free wireless internet is included! There is a portable AC unit located in the living room. There are also floor fans located in both bedrooms and the living room during the warmer months. ***There is no central AC. ***The house uses well water and is on a water softener. They can be found on Yelp. It is a short drive to waterfalls. It is a beautiful 45 min. drive to Asheville. Areas in the yard are left natural for wildlife such as birds or rabbits. They will have berries, grasses, and local flowers and honey bees/bumble bees. Other parts of the yard are mowed for walking around. Organic blackberries, mint, and concord grapes are in the yard when in season. **************************************************************************** ***********************THE AREA*************************************** There is a quaint movie theater ( $6.00 movies), grocery stores, public pool, local happenings at the town square, and restaurants that are located within minutes of the rental. Please call for availability The NeighborhoodWhat I love about the neighborhood is that you have a country setting and yet you are close enough to town. Getting AroundGrocery stores are within 7 minutes of the rental and a gas station in front of Ferguson Hill (Next to Advance Auto). The grocery store most people use is called Ingles. It is located on 19E about 5-7 minutes going East from Ferguson Hill. Downtown is only about 2-3 minutes from the house given traffic time. There you will find local shops and the Farmer's Market which sells locally grown produce. Many of the restaurants can be found there. Check Yelp for their good reviews! Other Things to NoteParking can be at the top of the property next to the stairs or on the driveway which is just down from that parking area on the right.

    The SpaceRomantic bedroom with a private Juliette balcony and private bath in a unique country home on 1 1/2 acres in an English garden setting. The house is surrounded by wonderful views and gardens including a koi pond. It is located 27 miles from downtown Asheville and 7 miles from the quaint town of Burnsville with close and easy access to Route 19 (the Burnsville Hwy - 4 lane). This is a great place to relax and enjoy a peaceful setting while just a short distance from many exciting activities including: Navitate (a canopy adventure), Mount Mitchell State Park (the highest point in the Eastern United States), Roan Mountain State Park, Gem Mountain, Wolf Laurel ski resort and riding stable (just 15 minutes from my house), Hot Springs, The Biltmore House, local artist studio tours, hiking and biking trails, rafting and tubing. My 12 chickens, provide farm fresh eggs for breakfast. I also specialize in organic gluten free baking and cooking since I am gluten free myself. Just let me know your breakfast requests and I will be sure to have whatever you would like, waiting for you. Autumn is a great time to visit. The town of Weaverville, just 20 minutes away, hosts a great festival: Art In Autumn, September 19th and the town of Burnsville hosts the Toe River Art Tour in October. Asheville also has several festivals that take place in the fall. The changing leaf colors are spectacular here in the mountains. Getting AroundI am in a rural location which means a vehicle is essential. My home is less than a mile from the Burnsville Highway which allows for easy access but distant enough to be free from highway noise. The Asheville Airport is about a 45 minute drive from my home. My driveway is suitable for two cars, mine and a guest Other Things to NoteI specialize in organic, specialty baking and cooking including gluten free and vegan meals, and will accommodate any diet. My home is very Zen with wonderful art. Space out and have me give you a massage on a 900sq ft deck hanging out over the mountains south and west. If you are lucky you will enjoy beautiful sunsets and even double rainbows. I am less than one hour from Asheville, NC or Johnson City, TN. Only 30 minutes from Mt. Laurel skiing. We have the best hiking (trails just finished to the highest peak in the Eastern USA) and biking in Western NC. Fishing is at the base of the mountain. Guests will have access to the kitchen for having beverages; storing food items; or, eating takeout if desired. I will welcome my guests into my home. Let you know about the area's activities that are happening during your stay. I will make sure you can find your way around and are comfortable. From my house you will need a car, taxi, NC Rideshare, etc. for your transportation needs. Please no excessive drinking or partying. Feel free to have a few guests over. I will welcome you into my home along with my four dogs. There is a cat that lives on the property whom you will never see. We will let you know about the area's activities. Micro cabin with outhouse on a conservation and demonstration duck farm. The cabin has a futon couch/bed downstairs, and a double bed and a twin bed in the loft, accessed by ladder. Cabin was built using green techniques and is cleaned with non-toxic cleaners. The entire property is chemical free, with no pesticides, herbicides, or other toxic chemicals being used on the property. Although there are cats on the property, they are never allowed in the cabin. The kitchenette in the cabin has a unit with two electric burners, a small fridge and a sink with cold running water. There is a coffee maker, a toaster oven, spices, pots and pans for your use. Come enjoy a non-judgmental atmosphere of relaxation and healing, surrounded by nature. Beautiful ducks, scenic landscapes here and nearby, lots to see here if you like being outdoors. Our 7 ponds are stocked with 6 species of fish and the property features a variety of flower beds, ornamental bushes, trees, and wildflowers. We have 5 endangered breeds of poultry on our farm, including the best egg-laying breeds of ducks.     This extremely unique 3 bedroom 2 bath home directly on the river has everything you could ask for when visiting the Black Mountains of North Carolina. The long driveway meanders through the forest running parallel to the Cane River passing by an old cattle barn and soon submerges you in a thick canopy of old growth Rhododendron. The canopy of Rhododendron you pass under with its imposing appearance leaves you with the feeling that you have entered a portal to natures own magical fairyland. You can't help but feel the elemental energy of natures finest. Spring time here is unbelievably beautiful with an abundance of wild flowers which cover the land like a carpet. You can expect to see Wild Iris, Lady Slippers, Showy Orchids, Trillium of all colors, Jack in the Pulpit, May Apples, Ferns of all varieties and much more. There is a large wrap around deck with views of the river, forest and old growth rhododendron with a gas grill and outdoor furniture for outside dinning. The interior of this home is all completely remodeled and has personal touches that make it just as unique as the land it sits on. Equipped with four TV's; a large flat screen in the living room the other 3 being in the game room, master bedroom and one of the secondary bedrooms . This beautiful home is located approximately 10 miles from Burnsville North Carolina and 40 minutes north of Asheville, North Carolina. If you are coming to the mountains to hike, fish, or just to relax , Then Vintage Creek is the place for you and your family. The house offers large glass windows from almost ever room where you can view the rushing creek and fall to sleep to the harmonizing sound of the water. There are three levels in the house. The main level offers a large living room and a wood burning fireplace ( firewood is provided ) There is seating for 8 to 10 guest in the dining area that also has views of the rushing creek, Large fully equipped kitchen and a glass sunroom off from the kitchen where you can sit and read or just capture the beautiful views. There is also one private queen bedroom that includes a full size bathroom and large closet. Now we can step up to the next level where you will find a large den, wood burning fireplace, computer room, library, and the master bedroom and bathroom.           The Sunset Ridge Cabin is a Mount Mitchell Cabin Rental perched near the top of a ridge overlooking Mount Celo, one of the 25 highest peaks in the Eastern United States. The property falls impressively away from the front deck of the house creating unbelievable views of the South Toe River Valley and Pisgah National Forest. Mount Mitchell, the highest point in the Eastern United States is minutes away and can be accessed via hiking trails or the world famous Blue Ridge Parkway. A true outdoor living space with a gas grill, ceiling fans, loungers and one of the finest views in Western NC. Also on the main level is the "Master Bedroom" with a king sized bed and comfy linens to insure a pleasant nights sleep. Take a long soak in the vintage claw foot bath tub in the "Bath of Romance" complete with a chandelier. Ou-la-la! The comfortable furnishings in the dining/living area beckon you to cozy up to the stone wood burning fire place, relax with a good book or enjoy television . A spiral stair case leads to the lower level and the family room. Perfect for the kids, games and a second tv area. Speaking of kids, "The Bunk House" western themed bedroom has two sets of bunk beds, vintage toys, games, etc to entertain little Cowboys and Cowgirls! Tenants agree to be responsible for any damages to the premises during their rental stay. This includes damages to the furnishings and household items that result from the action or inaction of Tenants or their invitees, excluding normal wear and tear. Tenants further agree to reimburse the Homeowner for collection costs, if necessary, and reasonable attorney fees. b.After Tenant's departure, the Property is inspected and inventoried for damages and missing items. North Carolina law allows 30 days from departure date for damages to be assessed and billed or accounted to Tenants. Tenants agree to report all losses or damages to the property owners no later than the departure date. We understand that accidents happen and these terms are the best way to make sure everyone is treated fairly in the event that damages occur. We are here to help, and will work with you to resolve any issues. Please treat your vacation rental with respect, and remember that we are sharing our home with you. 6. CANCELLATIONS, TRANSFERS, AND FORFEITS: d.All cancellations made within 30 days of arrival are non-refundable. In the event you must cancel your reservation within 30 days of arrival, please notify us as soon as possible. If you elected to purchase trip insurance, please contact the travel insurance company with your claim. e.If cancellations are made outside of the 30 days of arrival, your deposit will be refunded minus a $75 cancellation fee within 30 days of cancellation date. In order to move a reservation we must cancel the existing reservation. f.If the balance is not received 10 days prior to your arrival, we will treat the reservation as a cancellation. Your deposit will be forfeited. g.Insurance: We encourage all renters to purchase traveler insurance as well as Accidental Rental Damage Insurance, which cover most accidental damages. 7. OCCUPANCY: a.There must be an adult over the age of 18 present at all times if anyone under the age of 18 is in the property. No one under the age of 25 may rent the property under any circumstance. b.Maximum Occupancy refers to all persons over the age of one year old. Maximum Occupancy violations will result in rent forfeiture and immediate eviction of Tenants. Tenants will obey occupancy the 5-person limit at all times. Violations of maximum occupancy can cause property damage (for example, well and septic over-use) as well as violate local laws and regulations. Please obey our maximum occupancy limits at all times. Please respect maximum occupancy rules. This homes runs on private septic and a well system. Overtaxing these systems can cause serious problems. c.Absolutely no youth, high school, college groups, weddings, receptions, or meetings allowed. Any group whose behavior creates a disruption or interferes with a neighbor's peaceful enjoyment of their property will not be allowed to stay, and no refund of rents will be made. Any group misrepresenting themselves may be denied occupancy and no refund of rents will be made. Under no circumstances will use of the Property be authorized for illegal purposes, including groups that may be interested in allowing underage drinking. If such group attempts to occupy our rental property, all monies will be forfeited and Guests will be asked to vacate the Property immediately. d.Absolutely no firearms, pyrotechnics, unsupervised outdoor fires, off road dirt bikes, audible disturbances, or littering will be permitted on the rental premises. 8. OWNER DUTIES/MECHANICAL FAILURES/REPAIRS/APPLIANCES: a.The owner agrees to provide the Property to Guests in a fit and habitable condition. If at any time of occupancy the owner cannot provide Property in a fit and habitable condition, or reasonably cure the same or substitute a reasonably comparable property in such condition, the owner shall refund to Guest payments made. b.The owner is not responsible, nor will refunds be issued, for mechanical failures of non-essential or luxury items. In the case where the Property sustains a failure of a system or amenity (at the time of or during the tenancy), including, but not limited to, water, sewer, septic, heating, electrical, mechanical, ventilating, structural systems, fireplaces, air conditioning, pool, hot tub, jacuzzi, entertainment equipment, satellite/cable service, internet/internet access, or other facilities or major appliances, Homeowner shall promptly repair such system or amenity in a commercially reasonable manner and time upon receipt of written notification from Guest that repairs are needed. Guest agrees to permit the owner to access to the Property to inspect and make such repair in a commercially reasonable manner and time. Owner shall not be liable to Guest in damages and no refunds will be given for such temporary failure or minor disruption of any utilities, provided owner is causing the system or amenity to be repaired in a commercially reasonable manner and time after having received written notification from Guest that repairs are needed. Speed of service cannot be guaranteed due to the disbursement and remoteness of our rental property. c.This property includes a hot tub. Guests should only press the “jets” button. DO NOT adjust the temperate (this setting should remain on 101 degrees). Guests that press other buttons or change settings on the tub risk a loss of their deposit. Guests should be aware of some risks that can be associated with Hot Tub use. Some of these risks can include discoloration of swimwear due to chemicals used to sanitize tubs. ALSO, skin rashes / irritations may occur from chemicals or hot tub risk. Guests assume all responsibilities for these risks and consequences. Absolutely no pets are allowed in the Hot Tub. Children under the age of 15 are not allowed in the Hot Tub without parental supervision. Parents are fully responsible for children at all times. Special attention should be taken including, but not limited to, pregnant women, elderly, and disabled persons should use heavy caution while using the Hot Tubs. The owners cannot be held responsible for Hot Tub injuries or discomforts. Guests agree the owners are held harmless for all injuries / or undesired outcomes of hot tub use. d.The Guest is responsible for sanitizing the Hot Tub at the end of their stay. This is accomplished by placing 1 Tablespoons of Non-Chlorine Shock in the Hot Tub and turning on the jets. The tub should run for 20 minutes with the cover up. Guest must close the hot tub cover before departure (specific instructions are provided at the Property). IF THE TUB IS NOT IN SATISFACTORY CONDITION THE GUEST IS TO INFORM THE OWNER BEFORE USE (THIS INCUDES EXCESSIVE FOAM OR ODOR) If Guest use results in the Hot Tub becoming excessively dirty and the water in the Hot Tub requires purging, Guest will be charged a maintenance fee at a minimum charge of $200. Guest should NOT adjust the hot tub settings or a fee of $75 charged / withheld from damage deposit. e.This property includes a Bowflex. Guests should be aware of risks that can be associated with the fitness equipment. Some of these risks can include discomfort or injury resulting from overuse or misuse of the equipment. All Guests should consult a physician prior to use of said fitness equipment. Guest assumes all responsibilities for all risks and consequences resulting from use of exercise equipment. Absolutely no children under the age of 15 are allowed to use the equipment. Special attention should be taken including, but not limited to, pregnant women, elderly, and disabled persons should use heavy caution while using the equipment. Guests MUST READ ALL information and instructions that are provided with the equipment. If the Guest(s) does not fully understand the use of the equipment they shall not use the equipment. The owners cannot be held responsible for equipment injuries or discomforts that may result. Tenants agree the owners are held harmless for all injuries / or undesired outcomes of using the Bowflex or other exercise equipment. f.Cell phone service is not guaranteed at our rental properties. g.Construction or road noise near the Property is beyond our control. If you experience construction noise during your stay, no refunds or relocation will be made. h.In the event that rented premises becomes uninhabitable prior to rental period, or in the event of an error in reservation procedure or change in the ownership that precludes occupancy by the Guest, the owner reserves the right to effect appropriate corrective action without loss or liability to owner and is limited to rental monies paid by Guest. Notification of such corrective action will be provided to Guest at the earliest possible time. When renting a vacation property, you gain a wealth of amenities and features that you won't find at a hotel or resort. Unfortunately, even with rigorous maintenance, sometimes things stop working properly. This section covers how that affects your stay, things to be careful about when using the amenities, and what the owners will do in case a maintenance issue occurs at your vacation rental property. 9. WELL WATER AND PRESSURE: This property is on a shared well. Although the working condition of the equipment is maintained, water interruptions may be experienced particularly in times of drought or inclement weather. Please help us conserve water by using as little water as possible. Spread showers/baths out between morning and night, if possible. Please report any leaks or running toilets immediately so they can be repaired. Please conserve water! 10. ACCIDENTS: Guest agrees to hold owners harmless for any accident or injury whatsoever that may occur on the Property during occupancy. Guest must report any accidents or injuries to the owners immediately. Please be careful, owners cannot be held liable for your injuries. 11. PETS (see Addendum B): a.Tenants will be required to sign the property Pet Policy Addendum if they will bring a pet onto the property. Pet Addendum must be completed prior to arrival to the property. b.There is a $40 non-refundable pet fee per pet unless otherwise noted. c.Any misrepresentation regarding number of pets will be charged accordingly. d.Guests are held financially responsible for all physical damages to Property (i.e. chewing, scratching, flea infestation, etc.) inflicted on the Property by the presence of a pet. If extra cleaning is deemed reasonable due to the presence of a pet (i.e. soiled furniture and/or flooring, hair on furnishings or bedding, or fleas), the Guest will be held financially responsible and the credit card on file will be charged for the amount of the repair/recovery. e.All pets are required to be leashed when outside and no pet shall be tied outside the Property unless supervised by a responsible adult. f.Guest agrees to hold owners harmless for any pet injury or accident whatsoever that may occur on the Property during occupancy. We love our furry friends! Fines may be charged for undeclared pets and be aware that there are consequences for bringing unauthorized pets onto the property. 12. DIRECTIONS / KEY INFORMATION / WEATHER INFORMATION: a.The owners will provide detailed directions and key information to access vacation rental. Internet mapping devices and navigation systems are NOT recommended for use in the Western NC Mountains. Information regarding check-in procedures, including directions and Property key instructions, is sent via email upon full payment. It is the responsibility of the Guest to ensure receipt of directions 10 days after payment has been made. Directions should be printed in their entirety and used as a reference when driving to the Property. If you forget your directions, do not print them out in entirety, or are unable to locate the owners cannot be held responsible and no rent reduction or refund will be made. b.Please be aware that some NC mountain roads may be steep and/or curvy. Access to the property may be snow covered or icy and be difficult in inclement weather. Please adhere to safe travel requirements and know that we recommend four-wheel drive when inclement weather is expected or possible. It is highly recommended that Guests try to arrive during daylight hours for their first visit to the Property to become familiar with the area and roads. Parking at the bottom of the drive is a possibility if needed. No refunds will be given for storms. Mountain roads can be curvy and steep. Gravel drives are well maintained; however, we highly recommend four wheel drive and/or chains during the snow months. We do not refund due to road conditions. Mountain roads are gorgeous in the daylight: Arrive early! GPS doesn't always work in the mountains. It is strongly recommended that you print the directions. c.If there is a storm, no refunds will be given. There will be emergency heating available and the owners should be contacted in the event of a power outage or in the event of any other situation the guest(s) feels that owner should be informed. 13. PERSONAL ITEMS: Homeowners are NOT responsible for Guests’ personal belongings that are lost, stolen, or left behind. A $35 retrieval fee, plus shipping, will be charged, and if found, the items will be returned at the Guests' expense. "Pack-it-in, Pack-it-out": please be sure to take everything home with you that you brought to our property. 14. CARE OF PROPERTY / CLEANING: a.Each time the Guest(s) leave the property it is the sole responsibility of the Guest(s) to ensure that all major appliances (oven, electric fireplace, fans, etc.) are turned off. There are to be NO space heaters allowed in use on the property. The house alarm should be armed at all times when the house/property is unoccupied. b.Our property is professionally cleaned before you arrive and after you leave. Upon arrival, please notify the owners immediately if you do not find the Property in a suitable manner so that your concerns may be addressed, as the owners will make every effort to satisfy the Guest's needs, though no refunds will be made. If we have not heard from or received a phone call within 90 minutes of check-in, owners will assume Tenants are satisfied with the cleanliness of the home and no further action will be taken. c.Leave all beds used during stay unmade upon departure. Any linens/towels/or other furnished items (excluding consumable products) found missing from your stay will result in a replacement charge to the credit card on file. For multiple-week stays, light weekly housekeeping can be arranged during your stay at an extra cost. d.Tenants are responsible for cleaning and storing all dishes, utensils, and placing all trash in the appropriate outside container. By signing this agreement, the Tenant agrees to pay a secondary cleaning fee of $150 if checkout procedures are not followed as posted in Property and additional cleaning beyond the norm is deemed necessary. Let us know immediately if your property is not clean. We'll do our best to fix it. Please leave the property as you found it, and follow the checkout procedures. Also, please wash your own dishes before you leave. 15. CHECK-IN AND CHECKOUT PROCEDURES: a.CHECK-IN IS AFTER 4 P.M. Entering a property earlier than the stated 4 p.m. check-in time will result in a $60 plus tax early check-in fee being assessed and charged to the credit card on file. b.EARLY AND LATE CHECK-IN AND CHECKOUT: Requests for early check-in or late checkout will be considered on a case-by-case basis. Please contact us no more than 48 hours in advance with requests for an early arrival or late departure. Consideration is given based upon the properties “status” immediately prior to, or following, your reservation. The cost for either option is $60 plus tax, and is non-negotiable. c.CHECKOUT IS BY 11A.M. If the Property is not vacated by 11 a.m., the owners are authorized to enter the Property and remove Guest's belongings from the Property at Guest’s expense. Additionally, a late checkout fee of $60 plus tax will be assessed and charged to the credit card on file. The keys are to be left on the kitchen table and the alarm armed for you final departure. Please respect our check-in and checkout policies. Cleaning an entire house is a time-consuming process, and our housekeeping staff keeps a very tight schedule to ensure that each property is ready prior to a guest's arrival. 16. LOST KEY: Please don't lose the key to the property! There will be a $50 replacement cost if the key is lost. 17. This PROPERTIES OFFER AN INITIAL SUPPLY OF THE FOLLOWING AMENITIES including, but not limited to: linens and towels, dishwasher detergent, hand and body soaps (one set/bathroom), paper towels (1 roll), toilet paper (1 roll per bath room), and garbage bags, along with some cleaning implements. Property provides fully equipped kitchens or kitchenettes, including coffee makers as well stocked cooking utensils. Locked pantries and closets are reserved for the use of the Property Owner and are not included in this rental. Rearranging furniture or removing any items from the Property is prohibited. We make every effort to ensure your comfort during your stay. However, if there is anything that you will need during your vacation, we recommend that you bring it with you. 18. ADDITIONAL PROVISIONS/DISCLOSURES: a.The owner makes every effort to provide accurate information about the Property. Every effort has been made to assure that the information on the website and communicated by our staff is correct, however, it is not guaranteed. The website will contain the most up-to-date information, however, owners cannot be held responsible for changes made by Owners such as decor or bedding, or unintentional misrepresentation, and no refunds will be made for such Owners shall not be liable for unintentional errors, omissions, or changes in the advertisement of bedrooms and occupancy. The information herein is believed to be accurate and timely, but no warranty as such is expressed or implied. b.The provisions of this agreement are severable, and the unenforceability or invalidity of any provision of this Agreement shall not affect the remainder of the Agreement. The parties acknowledge that it is their intention that if any provision of this Agreement is determined by a court to be unenforceable or invalid as drafted, that provisions should be construed in a manner designed to effectuate the purpose of that provision to the greatest extent possible under applicable law. The parties hereby consent to the scope of such provision being judicially modified accordingly in any proceeding brought to enforce that provision. c.This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof, and cancels and supersedes all prior and contemporaneous agreements, understandings, negotiations and discussions of the parties, whether oral or written, relating to the subject matter hereof. This Agreement may not be amended except in a writing signed by all parties. d.The parties hereby consent and agree that if a dispute arises about the terms of this Agreement and a lawsuit or any other legal proceeding is initiated, the State of Tennessee has jurisdiction, and venue is proper in the County of Greene. We are pleased to accommodate both you and your furry family members! Before your upcoming stay, we would like to advise you of the following policies. Please review this information and complete this Agreement. 1. In the interest of protecting your pet, dogs should always be leashed when outside. While North Carolina does not have a state leash law, please note that cities and counties may have stricter regulations. For example, the Buncombe County (including Asheville City) law states: The city and county animal ordinances mandate that every person owning or having possession, charge, care, custody or control of any animal shall keep such animal exclusively upon his premises. However, such animal may be off such premises if it is under the physical control of a competent person and restrained by a chain, leash, harness or other means of physical control. Beginning Octob(PHONE NUMBER HIDDEN) any animal found running at large, in accordance with the ordinance definition, will be impounded. If an owner cannot be easily found the animal will be taken to the county animal shelter and will be micro-chipped, at the owners expense, before being released to the owner. 2. As a general rule, dogs should not be left unattended in properties. In an unfamiliar environment, dogs may act uncharacteristically and unpredictably. They may get nervous and bark, causing a disturbance to neighbors. Or they may harm the Property by chewing, scratching, or making messes that they would not typically make at home. For these reasons, please remember to be respectful of nearby neighbors and also to please use a crate in the rare event that a dog must be left alone in a rental. 3. For the safety of your pet, you should not leave pets unattended outside the Property. It is best to always stay with your dog when outdoors and use a leash. 4. To better serve you and your furry family member, our Concierge Service will arrange for walking, grooming, and playing with your pet. Call us for details and pricing. We will also happily recommend local groomers, doggie boutiques, and doggie day care or doggie resorts at no charge. PET ADDENDUM (Addendum B) It is hereby agreed by and between the Homeowners all Guests that homeowner will allow guest to have an approved pet and no others in the vacation home upon and subject to the terms and conditions of the rental agreement and this addendum. Guest hereby agrees to comply the following: 1. Guest to pay additional pet fee in the amount of $__40________. 2. All pets must comply with the following specifications (documentation from an accredited veterinarian must be provided by Guest upon request): a. May not exceed 70 lbs. b. Must be at least 1 year of age or older. c. Must be housebroken d. Must be up-to-date on rabies vaccinations and all other vaccinations. Heartworm preventive is highly recommended. e. Pets must be under treatment of an effective flea preventative (pets with fleas are not allowed) 3. All pets must be leashed at all times. 4. Guest is responsible for cleaning up any/all pet refuse. 5. Pets are not allowed on furniture at any time. Any evidence of pets on furniture may incur extra cleaning fees. 6. All pets are to be treated with a topical flea and tick repellent three (3) days prior to arrival. Fleas and ticks are very rampant in this area and can cause harmful/fatal illness to humans and pets. 7. Pet must not cause damage to premises or furnishings. If damages are caused, the cost of the damage will be deducted from security deposit. 8. Guest should prevent pets from producing excessive noise at a level that disturbs neighbors. 9. Pet will not be left unattended for an undue length of time, either indoors or out. Pet will not be left unattended on balcony, patio, or porch. 10. Homeowner assumes no responsibility for illness or injury that may incur to pets or humans while on the premises. The Guest shall be solely responsible for the pet while on the property. By booking your reservation you are accepting the rental contract and all addendums in full agreement to the terms specified within the foresaid documents. Other Things to NoteSHORT TERM RENTAL AGREEMENT (SUMMARY) This Short Term Rental Agreement (the “Agreement”) is made by and between Chris Cain and Frank Freeman (“Homeowner”) and (“Guest/s”) as of the date on-line booking takes place. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as OUTLINED IN THE FULL CONTRACT including Addendum A, the Hold Harmless Agreement and Addendum B and as follows: 1.Property. The property is located at 47 Beaver Lane, Burnsville, NC 28714. The property is fully furnished and includes (but not limited to) towels, bedding, kitchen utensils, a washer and dryer and exercise equipment, and an outdoor spa. 2.Rental Party: The rental party shall consist of the registered Guest/s listed at the time of rental. 3. Maximum Occupancy: The maximum number of guests is limited to 5 persons. People other than those in the Guest party set forth above may not stay overnight in the property. Any other person in the property is the sole responsibility of Guest. An additional charge of $100 per person per night for guests in addition to 5 will be assessed. 4. Term of the Lease: The lease begins at 4 p.m. on Check-in Date and ends at 11 a.m. on the “Checkout Date. 5. Minimum Stay: This property requires a 2-night minimum stay. Longer minimum stays may be required during holiday periods. If a rental is taken for less than 2 days, the guest will be charged the 2-night rate. 6. Rental Rules: Guest agrees to and shall abide by the full vacation rental agreement attached as Addendum A at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the said rules at all times while at the property. All guests with pets also agree to Addendum B. 7. Access: Guest shall allow Homeowner access to the property for purposes of repair and inspection. Homeowner shall exercise this right of access in a reasonable manner. 8. Rental Rate and Fees: Your deposit of 50% of the total rental is due immediately. The remaining 50% plus a damage deposit of $400.00 will be due no latter than 10 days prior to check-in. If this payment is not received it will be treated as a cancelation, refer to CANCELLATIONS, TRANSFERS, AND FORFEITS section of the rental contract Addendum A. The renter is solely responsible for any property damage, accident, injury or loss sustained to any person while in residence. Owner(s) Chris Cain and Frank Freeman and our Agents accept no legal or financial responsibility. Guests and guardians assume all risk of injury or other loss resulting from a recreational activity and will hold Owner/Agent harmless hereto. Guest hereby agrees to indemnify and hold Chris Cain & Frank Freeman, employees, and officers harmless from any claim, including those of third parties, arising out of or in any way a result of the guest’s use of the premises or items therein. Owner/Agent (Chris Cain, Frank Freeman and employees) cannot be held responsible for: The failing of any other company due to said company’s error or service interruption {i.e. electricity, water, gas, cable, wireless provider, etc.} and acts of neighbors such as: construction, road repair and maintenance or act of god (weather). However, Owners/Agent agree to do all that is humanly possible to remedy any issue as quickly as possible. NO REFUNDS OR ADJUSTMENTS OF RENTAL FEES WILL BE MADE FOR ANY OF THE ABOVE CONDITIONS. Interest accrued will be paid to the owners of the account. However, the damage deposit will be held and refunded by airbnb.com in their escrow account no interest will be earned by the homeowner. Your deposit of 50% of the total is due immediately. The remaining 50% plus the damage deposit $400.00 will be due no latter than 10 days prior to check-in. If this payment is not received it will be treated as a cancelation. Rental rate and fees are as follows: •$120-140 per night plus, •Cleaning fee of $70.00 plus, •Sales Tax calculated @ 7% plus, •Occupancy Tax calculated @ 3% plus, •Damage deposit (refundable) of $400 The total payment is due on or before 10 days prior to check-in. 3. OTHER CHARGES AND FEES: a.Smoking inside the rental home is PROHIBITED. This property is NON-SMOKING. If this regulation is violated and smoking has been detected in the property, a $250 penalty for cleaning services due to unauthorized smoking will be charged to the credit card on file. By signing this agreement the property owners are authorized to charge this fee to your credit card. Please do not smoke in our vacation rental! b.A fee of $50 will be charged for all returned checks. c.All reservations incur 7% NC Sales Tax and Yancey County Occupancy Tax of 3% in addition to the rental amounts and fees. Rates are subject to applicable state sales and county occupancy taxes, which are in effect during the time of your stay. Please note that these are subject to change as authorized by the appropriate governing body. The property owners will adjust your reservation to reflect current tax rates, which are in effect at the time of your stay. The owners will credit or debit your account for tax changes. d.A security/damage deposit of $ 400.00 is due at least 10 days prior to the Check-In date. This deposit is for security/damage and shall be refunded within 45 days of the Check-out date, provided no deductions are made due to: •damage to the property or furnishings; •dirt or other mess requiring excessive cleaning; or •excessive cleaning required of hot tub; or •any other cost incurred by Homeowner due to Guest’s stay. If the premises appear dirty or damaged upon Check-in, Guest shall inform Homeowner immediately. 5. DAMAGES: a.Immediately upon arrival, Tenants agree to notify the property owners of any noticeable damages or conditions requiring repair or maintenance. Tenants agree to be responsible for any damages to the premises during their rental stay. This includes damages to the furnishings and household items that result from the action or inaction of Tenants or their invitees, excluding normal wear and tear. Tenants further agree to reimburse the Homeowner for collection costs, if necessary, and reasonable attorney fees. b.After Tenant's departure, the Property is inspected and inventoried for damages and missing items. North Carolina law allows 30 days from departure date for damages to be assessed and billed or accounted to Tenants. Tenants agree to report all losses or damages to the property owners no later than the departure date. We understand that accidents happen and these terms are the best way to make sure everyone is treated fairly in the event that damages occur. We are here to help, and will work with you to resolve any issues. Please treat your vacation rental with respect, and remember that we are sharing our home with you. 6. CANCELLATIONS, TRANSFERS, AND FORFEITS: d.All cancellations made within 30 days of arrival are non-refundable. In the event you must cancel your reservation within 30 days of arrival, please notify us as soon as possible. If you elected to purchase trip insurance, please contact the travel insurance company with your claim. e.If cancellations are made outside of the 30 days of arrival, your deposit will be refunded minus a $75 cancellation fee within 30 days of cancellation date. In order to move a reservation we must cancel the existing reservation. f.If the balance is not received 10 days prior to your arrival, we will treat the reservation as a cancellation. Your deposit will be forfeited. g.Insurance: We encourage all renters to purchase traveler insurance as well as Accidental Rental Damage Insurance, which cover most accidental damages. 7. OCCUPANCY: a.There must be an adult over the age of 18 present at all times if anyone under the age of 18 is in the property. No one under the age of 25 may rent the property under any circumstance. b.Maximum Occupancy refers to all persons over the age of one year old. Maximum Occupancy violations will result in rent forfeiture and immediate eviction of Tenants. Tenants will obey occupancy the 5-person limit at all times. Violations of maximum occupancy can cause property damage (for example, well and septic over-use) as well as violate local laws and regulations. Please obey our maximum occupancy limits at all times. Please respect maximum occupancy rules. This homes runs on private septic and a well system. Overtaxing these systems can cause serious problems. c.Absolutely no youth, high school, college groups, weddings, receptions, or meetings allowed. Any group whose behavior creates a disruption or interferes with a neighbor's peaceful enjoyment of their property will not be allowed to stay, and no refund of rents will be made. Any group misrepresenting themselves may be denied occupancy and no refund of rents will be made. Under no circumstances will use of the Property be authorized for illegal purposes, including groups that may be interested in allowing underage drinking. If such group attempts to occupy our rental property, all monies will be forfeited and Guests will be asked to vacate the Property immediately. d.Absolutely no firearms, pyrotechnics, unsupervised outdoor fires, off road dirt bikes, audible disturbances, or littering will be permitted on the rental premises. 8. OWNER DUTIES/MECHANICAL FAILURES/REPAIRS/APPLIANCES: a.The owner agrees to provide the Property to Guests in a fit and habitable condition. If at any time of occupancy the owner cannot provide Property in a fit and habitable condition, or reasonably cure the same or substitute a reasonably comparable property in such condition, the owner shall refund to Guest payments made. b.The owner is not responsible, nor will refunds be issued, for mechanical failures of non-essential or luxury items. In the case where the Property sustains a failure of a system or amenity (at the time of or during the tenancy), including, but not limited to, water, sewer, septic, heating, electrical, mechanical, ventilating, structural systems, fireplaces, air conditioning, pool, hot tub, jacuzzi, entertainment equipment, satellite/cable service, internet/internet access, or other facilities or major appliances, Homeowner shall promptly repair such system or amenity in a commercially reasonable manner and time upon receipt of written notification from Guest that repairs are needed. Guest agrees to permit the owner to access to the Property to inspect and make such repair in a commercially reasonable manner and time. Owner shall not be liable to Guest in damages and no refunds will be given for such temporary failure or minor disruption of any utilities, provided owner is causing the system or amenity to be repaired in a commercially reasonable manner and time after having received written notification from Guest that repairs are needed. Speed of service cannot be guaranteed due to the disbursement and remoteness of our rental property. c.This property includes a hot tub. Guests should only press the “jets” button. DO NOT adjust the temperate (this setting should remain on 101 degrees). Guests that press other buttons or change settings on the tub risk a loss of their deposit. Guests should be aware of some risks that can be associated with Hot Tub use. Some of these risks can include discoloration of swimwear due to chemicals used to sanitize tubs and minor skin rashes if sensitive to the chemicals. Guests assume all responsibilities for these risks and consequences. Absolutely no pets are allowed in the Hot Tub. Children under the age of 15 are not allowed in the Hot Tub without parental supervision. Parents are fully responsible for children at all times. Special attention should be taken including, but not limited to, pregnant women, elderly, and disabled persons should use heavy caution while using the Hot Tubs. The owners cannot be held responsible for Hot Tub injuries or discomforts. Guests agree the owners are held harmless for all injuries / or undesired outcomes of hot tub use. d.The Guest is responsible for sanitizing the Hot Tub at the end of their stay. This is accomplished by placing 1 Tablespoons of Non-Chlorine Shock in the Hot Tub and turning on the jets. The tub should run for 20 minutes with the cover up. Guest must close the hot tub cover before departure (specific instructions are provided at the Property). If Guest use results in the Hot Tub becoming excessively dirty and the water in the Hot Tub requires purging, Guest will be charged a maintenance fee at a minimum charge of $200. Guest should NOT adjust the hot tub settings or a fee of $75 charged / withheld from damage deposit. e.This property includes a Bowflex. Guests should be aware of risks that can be associated with the fitness equipment. Some of these risks can include discomfort or injury resulting from overuse or misuse of the equipment. All Guests should consult a physician prior to use of said fitness equipment. Guest assumes all responsibilities for all risks and consequences resulting from use of exercise equipment. Absolutely no children under the age of 15 are allowed to use the equipment. Special attention should be taken including, but not limited to, pregnant women, elderly, and disabled persons should use heavy caution while using the equipment. Guests MUST READ ALL information and instructions that are provided with the equipment. If the Guest(s) does not fully understand the use of the equipment they shall not use the equipment. The owners cannot be held responsible for equipment injuries or discomforts that may result. Tenants agree the owners are held harmless for all injuries / or undesired outcomes of using the Bowflex or other exercise equipment. f.Cell phone service is not guaranteed at our rental properties. g.Construction or road noise near the Property is beyond our control. If you experience construction noise during your stay, no refunds or relocation will be made. h.In the event that rented premises becomes uninhabitable prior to rental period, or in the event of an error in reservation procedure or change in the ownership that precludes occupancy by the Guest, the owner reserves the right to effect appropriate corrective action without loss or liability to owner and is limited to rental monies paid by Guest. Notification of such corrective action will be provided to Guest at the earliest possible time. When renting a vacation property, you gain a wealth of amenities and features that you won't find at a hotel or resort. Unfortunately, even with rigorous maintenance, sometimes things stop working properly. This section covers how that affects your stay, things to be careful about when using the amenities, and what the owners will do in case a maintenance issue occurs at your vacation rental property. 9. WELL WATER AND PRESSURE: This property is on a shared well. Although the working condition of the equipment is maintained, water interruptions may be experienced particularly in times of drought or inclement weather. Please help us conserve water by using as little water as possible. Spread showers/baths out between morning and night, if possible. Please report any leaks or running toilets immediately so they can be repaired. Please conserve water! 10. ACCIDENTS: Guest agrees to hold owners harmless for any accident or injury whatsoever that may occur on the Property during occupancy. Guest must report any accidents or injuries to the owners immediately. Please be careful, owners cannot be held liable for your injuries. 11. PETS (see Addendum B): a.Tenants will be required to sign the property Pet Policy Addendum if they will bring a pet onto the property. Pet Addendum must be completed prior to arrival to the property. b.There is a $40 non-refundable pet fee per pet unless otherwise noted. c.Any misrepresentation regarding number of pets will be charged accordingly. d.Guests are held financially responsible for all physical damages to Property (i.e. chewing, scratching, flea infestation, etc.) inflicted on the Property by the presence of a pet. If extra cleaning is deemed reasonable due to the presence of a pet (i.e. soiled furniture and/or flooring, hair on furnishings or bedding, or fleas), the Guest will be held financially responsible and the credit card on file will be charged for the amount of the repair/recovery. e.All pets are required to be leashed when outside and no pet shall be tied outside the Property unless supervised by a responsible adult. f.Guest agrees to hold owners harmless for any pet injury or accident whatsoever that may occur on the Property during occupancy. We love our furry friends! Fines may be charged for undeclared pets and be aware that there are consequences for bringing unauthorized pets onto the property. 12. DIRECTIONS / KEY INFORMATION / WEATHER INFORMATION: a.The owners will provide detailed directions and key information to access vacation rental. Internet mapping devices and navigation systems are NOT recommended for use in the Western NC Mountains. Information regarding check-in procedures, including directions and Property key instructions, is sent via email upon full payment. It is the responsibility of the Guest to ensure receipt of directions 10 days after payment has been made. Directions should be printed in their entirety and used as a reference when driving to the Property. If you forget your directions, do not print them out in entirety, or are unable to locate the owners cannot be held responsible and no rent reduction or refund will be made. b.Please be aware that some NC mountain roads may be steep and/or curvy. Access to the property may be snow covered or icy and be difficult in inclement weather. Please adhere to safe travel requirements and know that we recommend four-wheel drive when inclement weather is expected or possible. It is highly recommended that Guests try to arrive during daylight hours for their first visit to the Property to become familiar with the area and roads. Parking at the bottom of the drive is a possibility if needed. No refunds will be given for storms. Mountain roads can be curvy and steep. Gravel drives are well maintained; however, we highly recommend four wheel drive and/or chains during the snow months. We do not refund due to road conditions. Mountain roads are gorgeous in the daylight: Arrive early! GPS doesn't always work in the mountains. It is strongly recommended that you print the directions. c.If there is a storm, no refunds will be given. There will be emergency heating available and the owners should be contacted in the event of a power outage or in the event of any other situation the guest(s) feels that owner should be informed. 13. PERSONAL ITEMS: Homeowners are NOT responsible for Guests’ personal belongings that are lost, stolen, or left behind. A $35 retrieval fee, plus shipping, will be charged, and if found, the items will be returned at the Guests' expense. "Pack-it-in, Pack-it-out": please be sure to take everything home with you that you brought to our property. 14. CARE OF PROPERTY / CLEANING: a.Each time the Guest(s) leave the property it is the sole responsibility of the Guest(s) to ensure that all major appliances (oven, electric fireplace, fans, etc.) are turned off. There are to be NO space heaters allowed in use on the property. The house alarm should be armed at all times when the house/property is unoccupied. b.Our property is professionally cleaned before you arrive and after you leave. Upon arrival, please notify the owners immediately if you do not find the Property in a suitable manner so that your concerns may be addressed, as the owners will make every effort to satisfy the Guest's needs, though no refunds will be made. If we have not heard from or received a phone call within 90 minutes of check-in, owners will assume Tenants are satisfied with the cleanliness of the home and no further action will be taken. c.Leave all beds used during stay unmade upon departure. Any linens/towels/or other furnished items (excluding consumable products) found missing from your stay will result in a replacement charge to the credit card on file. For multiple-week stays, light weekly housekeeping can be arranged during your stay at an extra cost. d.Tenants are responsible for cleaning and storing all dishes, utensils, and placing all trash in the appropriate outside container. By signing this agreement, the Tenant agrees to pay a secondary cleaning fee of $150 if checkout procedures are not followed as posted in Property and additional cleaning beyond the norm is deemed necessary. Let us know immediately if your property is not clean. We'll do our best to fix it. Please leave the property as you found it, and follow the checkout procedures. Also, please wash your own dishes before you leave. 15. CHECK-IN AND CHECKOUT PROCEDURES: a.CHECK-IN IS AFTER 4 P.M. Entering a property earlier than the stated 4 p.m. check-in time will result in a $60 plus tax early check-in fee being assessed and charged to the credit card on file. b.EARLY AND LATE CHECK-IN AND CHECKOUT: Requests for early check-in or late checkout will be considered on a case-by-case basis. Please contact us no more than 48 hours in advance with requests for an early arrival or late departure. Consideration is given based upon the properties “status” immediately prior to, or following, your reservation. The cost for either option is $60 plus tax, and is non-negotiable. c.CHECKOUT IS BY 11A.M. If the Property is not vacated by 11 a.m., the owners are authorized to enter the Property and remove Guest's belongings from the Property at Guest’s expense. Additionally, a late checkout fee of $60 plus tax will be assessed and charged to the credit card on file. The keys are to be left on the kitchen table and the alarm armed for you final departure. Please respect our check-in and checkout policies. Cleaning an entire house is a time-consuming process, and our housekeeping staff keeps a very tight schedule to ensure that each property is ready prior to a guest's arrival. 16. LOST KEY: Please don't lose the key to the property! There will be a $50 replacement cost if the key is lost. 17. This PROPERTIES OFFER AN INITIAL SUPPLY OF THE FOLLOWING AMENITIES including, but not limited to: linens and towels, dishwasher detergent, hand and body soaps (one set/bathroom), paper towels (1 roll), toilet paper (1 roll per bath room), and garbage bags, along with some cleaning implements. Property provides fully equipped kitchens or kitchenettes, including coffee makers as well stocked cooking utensils. Locked pantries and closets are reserved for the use of the Property Owner and are not included in this rental. Rearranging furniture or removing any items from the Property is prohibited. We make every effort to ensure your comfort during your stay. However, if there is anything that you will need during your vacation, we recommend that you bring it with you. 18. ADDITIONAL PROVISIONS/DISCLOSURES: a.The owner makes every effort to provide accurate information about the Property. Every effort has been made to assure that the information on the website and communicated by our staff is correct, however, it is not guaranteed. The website will contain the most up-to-date information, however, owners cannot be held responsible for changes made by Owners such as decor or bedding, or unintentional misrepresentation, and no refunds will be made for such Owners shall not be liable for unintentional errors, omissions, or changes in the advertisement of bedrooms and occupancy. The information herein is believed to be accurate and timely, but no warranty as such is expressed or implied. b.The provisions of this agreement are severable, and the unenforceability or invalidity of any provision of this Agreement shall not affect the remainder of the Agreement. The parties acknowledge that it is their intention that if any provision of this Agreement is determined by a court to be unenforceable or invalid as drafted, that provisions should be construed in a manner designed to effectuate the purpose of that provision to the greatest extent possible under applicable law. The parties hereby consent to the scope of such provision being judicially modified accordingly in any proceeding brought to enforce that provision. c.This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof, and cancels and supersedes all prior and contemporaneous agreements, understandings, negotiations and discussions of the parties, whether oral or written, relating to the subject matter hereof. This Agreement may not be amended except in a writing signed by all parties. d.The parties hereby consent and agree that if a dispute arises about the terms of this Agreement and a lawsuit or any other legal proceeding is initiated, the State of Tennessee has jurisdiction, and venue is proper in the County of Greene. We are pleased to accommodate both you and your furry family members! Before your upcoming stay, we would like to advise you of the following policies. Please review this information and complete this Agreement. 1. In the interest of protecting your pet, dogs should always be leashed when outside. While North Carolina does not have a state leash law, please note that cities and counties may have stricter regulations. For example, the Buncombe County (including Asheville City) law states: The city and county animal ordinances mandate that every person owning or having possession, charge, care, custody or control of any animal shall keep such animal exclusively upon his premises. However, such animal may be off such premises if it is under the physical control of a competent person and restrained by a chain, leash, harness or other means of physical control. Beginning Octob(PHONE NUMBER HIDDEN) any animal found running at large, in accordance with the ordinance definition, will be impounded. If an owner cannot be easily found the animal will be taken to the county animal shelter and will be micro-chipped, at the owners expense, before being released to the owner. 2. As a general rule, dogs should not be left unattended in properties. In an unfamiliar environment, dogs may act uncharacteristically and unpredictably. They may get nervous and bark, causing a disturbance to neighbors. Or they may harm the Property by chewing, scratching, or making messes that they would not typically make at home. For these reasons, please remember to be respectful of nearby neighbors and also to please use a crate in the rare event that a dog must be left alone in a rental. 3. For the safety of your pet, you should not leave pets unattended outside the Property. It is best to always stay with your dog when outdoors and use a leash. 4. To better serve you and your furry family member, our Concierge Service will arrange for walking, grooming, and playing with your pet. Call us for details and pricing. We will also happily recommend local groomers, doggie boutiques, and doggie day care or doggie resorts at no charge. PET ADDENDUM (Addendum B) It is hereby agreed by and between the Homeowners all Guests that homeowner will allow guest to have an approved pet and no others in the vacation home upon and subject to the terms and conditions of the rental agreement and this addendum. Guest hereby agrees to comply the following: 1. Guest to pay additional pet fee in the amount of $__40________. 2. All pets must comply with the following specifications (documentation from an accredited veterinarian must be provided by Guest upon request): a. May not exceed 70 lbs. b. Must be at least 1 year of age or older. c. Must be housebroken d. Must be up-to-date on rabies vaccinations and all other vaccinations. Heartworm preventive is highly recommended. e. Pets must be under treatment of an effective flea preventative (pets with fleas are not allowed) 3. All pets must be leashed at all times. 4. Guest is responsible for cleaning up any/all pet refuse. 5. Pets are not allowed on furniture at any time. Any evidence of pets on furniture may incur extra cleaning fees. 6. All pets are to be treated with a topical flea and tick repellent three (3) days prior to arrival. Fleas and ticks are very rampant in this area and can cause harmful/fatal illness to humans and pets. 7. Pet must not cause damage to premises or furnishings. If damages are caused, the cost of the damage will be deducted from security deposit. 8. Guest should prevent pets from producing excessive noise at a level that disturbs neighbors. 9. Pet will not be left unattended for an undue length of time, either indoors or out. Pet will not be left unattended on balcony, patio, or porch. 10. Homeowner assumes no responsibility for illness or injury that may incur to pets or humans while on the premises. The Guest shall be solely responsible for the pet while on the property. (But don't worry about hearing their delighted squeals! The school is a mile away, over the ridge.) Celo Community and the nearby Penland School of Crafts has enriched this area with a wealth of talent--particularly artistic talent in the form of world class artisans working in wood, hot art glass, pottery, fibre, and all the rest. You may want to use this cabin as headquarters for exploring all of the local culture or for exploring some of the trails of the Black Mountains, just across the road and the tallest chain east of the Rockies. Or you may want to just hang out in this romantic get-away and enjoy the rockers, the games, a book, the hammocks, the clear river in the front yard, the shower and footed tub in the woods, or the hot-tub--and each other.               The cabin has 2 bedrooms plus a sleeping loft and can comfortably sleep 5 adults and two children. There is a modern Kitchen(complete with a gas stove and antique wood burning cook stove), comfortable living room with working stone fireplace, and two bathrooms. The cabin was lovingly hand built by the owner and contains no store bought wood. All the wood was recycled from old log homes, barns, and sheds located in North Carolina. Rocking chair front porch and deck. Rates include all house hold basics including bedding, soap, towles,cooking utensils, etc The Log Rustic Log Cabin is located in a very private setting bordering the Pisgah National Forest. It's at the base of Mt Mitchell, the tallest mountain East of the Mississippi. It is also within several feet of Rock Creek, which is the largest water shed off of Mt Mitchell. It is within a couple miles of Mt Mitchell Golf Course, and 15 miles from interesting shopping areas. The local economy is based largely on arts and crafts.

              The Nu Wray Inn was originally built in 1833. We have 13 Rooms at the Inn and are located in the heart of Burnsville NC, just steps from the square and lots of shops and restaurants. We also operate the restaurant with a beer and wine bar at the Inn on weekends if you want a hearty meal to get you going before you head out for your daily adventure.               The SpaceIt is peaceful and quiet, and very relaxing. It is a quiet getaway. If you go out on the deck at night and look up , you will see thousands of stars. There is Netfix and Pandora for your enjoyment. There is also Wi Fi. This cabin has essential business travel amenities. It is on 22 acres and sits at 3,500' elevation. The deck has a propane grill that is connected to the main tank, so there is no need to buy propane tanks. Guest AccessGuests may walk behind their cabin to the end of the fence line only. They may not enter the fenced area and certainly my not enter any door or opening in the barn. If they enter the woods , they will do it at their own risks and possible peril. There are bobcats, skunks, coyotes, snakes, deer, and other wildlife. They should be the judge as I have forewarned them. Interaction with GuestsI can and will be glad to offer them help throughout their stay. The NeighborhoodThe neighborhood is unique in that it is off a dead-end road. It has maybe 10 houses on it and the last sheriff is one of those people. There are many acres of livestock. It is very, very quiet at all times. Getting AroundIf you want to get out but stay close, walk down the driveway, cross the street and fish for mountain trout; then take it home and grill it. Burnsville is one of N.C.'s entrepeneurial communities; it is a sightseer's paradise with indescribable landscapes. Festivals and fairs bring music and laughter.
