Short Term Vacation Rental Agreement
Section 1 – Parties, Property, Terms
Upon the terms and conditions herein stated, this Vacation Rental Agreement (“Agreement”) is entered into between Charlene Bland (“owner”) and the Guest identified below (“Guest”). Guest Information:

1.Term: This Agreement is for a Term beginning on ______________ (“Arrival Date”) and ending on ______________ (“Departure Date”). Check-in is after 3PM and Check-out is 12 NOON. Early departure refunds are not available. Adjustment on these times must be pre-approved by Charlene.
2.Property: The short-term vacation rental property (“Property”) is(URL HIDDEN)31673 Blackbird Lane, Strawberry, CA 95375 (GPS has been sending people to funny places, turn left after Strawberry Inn on HWY 108, turn right at the Y (meadow) and Blackbird is midway up the hill----if you cross a bridge you turned wrong way at the Y.)
3.Occupancy Limit: The maximum number of guests allowed at the Property at any one time is 10. All guests over the age of 2 are counted towards the maximum. Any party falsely representing the number of people in the home, or exceeding the maximum may be subject to immediate eviction without refund.
4.Parking Limit for Property: The maximum number of vehicles allowed at the Property at any one time is 4. Note: Parking on the actual street is restricted in the winter months so that the snowplows can operate efficiently. One garage space, and 3 spaces in the black top parking area left of the garage under the trees. Someone comes to plow the front of the garage and driveway during snow.
5.Rental Amount, Fees and Payments: It is agreed that the Rent and Fees for the Property is:

Section 2 – Cancellation, Damage, Indemnification, Liability, and Destruction
1.Cancellations: (a) If the Property becomes unavailable to the Guest prior to occupancy, for any reason, Owner agrees to refund the full amount paid to the date of cancellation, and Guest agrees to release any claims against owner. (b) If, for any reason, the Guest cancels this Agreement more than Three (3) days from the Arrival Date, Guest will receive a refund of amounts paid, less a $45 cancellation fee depending on the individual situation.
2.Damage Repair and Missing Items: Responsibility of the Guest or Guest’s visitors-Damages from unauthorized pets, extensive cleaning required and or smoke damage will be the responsibility of the Guest. Any other charges/policies including any fines imposed locally due to a violation of any law, ordinance, rule or regulation or any fines or cost levied against Guest or Guest’s visitors (“Excess Damage Costs”), to the Property and its contents. Guest will be notified of any Excess Damage Costs in writing.
3.Indemnification and Insurance: Guest agrees to indemnify and hold harmless the owner of the Property against all loss, damage, expense, and penalty arising from any action of the Guest or Guest’s visitors who cause injury or death to any person or damage to any property.
4.Casualty or Destruction: Should the Property be destroyed or rendered uninhabitable by an Act of God (including, but not limited to, storms, floods, or fires) or by environmental disaster, or loss of utilities prior to occupancy by Guest, this Agreement shall become null and void, and all payments made hereunder shall be refunded to Guest.
Section 3 – Short Term Vacation Rental Policies
1.Cleaning: The property will be inspected and cleaned after departure. Guest is required to leave the property in the same general condition that it was received. Please leave beds that were used---UNMADE. Place used towels and any other dirty laundry in the basement in the laundry room please.
2.Key and Security System: There is a digital lock on the door of entry to the cabin. The code is 5423 – enter the code and turn the knob to unlock. Do the same to lock and turn the knob the opposite way. After entry, turn the security system off by entering 5423, press the number button that says OFF. To set the security system, all doors including the garage must be closed. Enter the code and press the number button that says AWAY. If for some reason the alarm goes off: call (PHONE NUMBER HIDDEN)st Security & Sound. The password PENNY. No Garage Door Opener at this time.

3.Trash: All trash must be taken with each renter upon departure. There is no garbage pick up for this cabin. During the summer months, the garbage dump/recycling center is open on Hwy 108 just past the Pinecrest entrance heading away from Strawberry. For a small fee trash and recycling can be dropped off during certain times of the year. Closed most of the winter.
4.Repairs and Maintenance: Repair and maintenance problems must be brought to owners immediately upon arrival or Guest will be held liable for all such damages or repairs. Appliance malfunctions or service requests will be responded to as quickly as possible. There will be no rebates or refunds issued to Guest for any reason as every good faith effort is made to insure the property is maintained to highest standards. In case the electric goes out, there is a generator that should automatically kick on. Please note, occasionally the cable will go out, feel free to call Sierra Communications, if this were to happen. The electric is with PG&E. Various batteries in the desk drawers. Manuals for various items in the desk.
5.Emergency Contacts: If you are unable to reach Charlene at (PHONE NUMBER HIDDEN), please try to contact Danny Rutherford at (PHONE NUMBER HIDDEN) OR Kim Cowan at (PHONE NUMBER HIDDEN) (she does the cleaning as well) OR Marvin Taylor at (PHONE NUMBER HIDDEN) or (PHONE NUMBER HIDDEN).Pets: Pets are not allowed in or on the Property, unless preapproved by Charlene.
7.Telephone, Cable and Internet: Phone is available for local and long distance calling in the United States. Number: (PHONE NUMBER HIDDEN) (keep the answering machine OFF to allow the remote system to function for turning on the heat in advance of arrival—see below under Heating). Cable is with Sierra Communications at (PHONE NUMBER HIDDEN). Note: Cable does go on and off at times especially with heavy snow. Internet: NONE outside of cell coverage---beauty of the cabin in the mountains. Cell coverage is non existent with AT&T, reasonably good with Verizon and Sprint.
8.Smoking: Smoking is strictly forbidden inside the Property including the basement. Smoking is allowed outside the Property with proper care and attention to fire safety and avoid any undue fire hazard.
9.Fireplace: There is a wood burning fireplace. Please keep the flue open at all times. There is fully stocked wood that you are welcome to burn. Bring fire starters and or Duraflames for starting fires. May want to bring a few for your stay. Please put any ashes cleaned out of the fireplace in the bins on the side of the garage.

10.Appliances and Griil: Feel free to use any and all of the appliances, such as: crockpot, mixer, electric griddle, Panini maker, toaster, Keurig coffee maker (bring your own Keurig pods), refrigerator in garage and in the kitchen, electric roaster oven, etc. There is a small Weber grill that uses small butane tanks (may want to bring a couple if you plan to grill alot), charcoal burning weber and another charcoal grill. Kitchen is fully stocked with dishes, pots and pans, etc.
11.Linens and Towels: Fully stocked.
12.Heating: You may call the cabin 3-4 hours ahead of arrival and adjust the temperature so the cabin will be warm upon arrival. Call (PHONE NUMBER HIDDEN), passcode 1234. Enter 64 for the degree setting. That is usually pretty warm, may need to adjust a degree or two while there. Instructions are available on the thermostat. Be sure to hit RUN PROGRAM when you depart, setting of 45 degrees is the standard when no one is there.
13.Short-Term Rental: It is expressly understood and agreed that this is a short-term vacation, and is not a lease or other long-term residential tenancy agreement. This Agreement is only for the licensed use of the Property for the stated Term. It creates no property rights in Guest and no rights to renewal or for recurring usage unless approved by Charlene.
14.Succession, Assignment: This Agreement is binding on, and the benefits inure to, the heirs and personal representatives of the parties. This Agreement or any rights hereunder, may not be assigned (in whole or in part) by Guest.
15.General Terms: This Agreement is made in, and shall be governed solely by the laws of, the State of California. Guest is to be mindful that this Property is located in a residential neighborhood. Guest is expected to be courteous to residents and other guests, to be respectful of the rights of others, and to peacefully enjoy the property so as not to be a disturbance to others.
16.Acknowledgement: I/We understand and accept the terms and conditions of all pages of this Agreement, and that the following Damage Waiver is part of this agreement.
