THIS LEASE AGREEMENT, MADE THIS, __________day of __________, by and between TERRY L. EDWARDS (“Owner”), whose address is 12773 S. Eastside Hwy, Port Republic, VA 24471 and ***** ******* whose address is ******* *********** **************.
Tenant must be at least twenty-five years of age.
In consideration of the mutual promises and covenants set forth below, as well as other good and valuable considerations, the receipt of which is hereby acknowledged, the parties hereto agree as follows: REAL PROPERTY AND TERM OF OCCUPANCY. Owner hereby leases to Tenant Crimora Mine Retreat, 691 Crimora Mine Road, Crimora, VA 24431 (hereinafter the “Premises”), for the term of *** nights commencing at 4 PM on ********** ** **** (*****) and expiring at noon on ******* ** **** (******).
1.PERSONAL PROPERTY. The Premises is fully furnished.
2.USE OF PREMISES. The Premises will be used by Tenant as a vacation rental and for no other purpose.
3.OCCUPANY: Crimora Mine Retreat provides arrangements for 10 persons. If your group has excess of 10 persons, please contact the Owner initially to make additional accommodations. Excess of 10 persons without notification of Owner will result in the forfeit of security deposit.
4.RENT AND DEPOSIT. Tenant agrees to pay the rental sum of $******, plus 5.3% Virginia tax of $***.**, which shall be due and payable in advance. An additional holding/security deposit of FIVE HUNDRED DOLLARS ($500.00) shall be paid by Tenant upon signing of this lease. Full payment is required four weeks prior to occupancy. The deposit will be returned to the Tenant after inspection of the Premises and it being found to comply with the term of this lease.
5.PAYMENT. Credit card payment can be made with Visa or MasterCard. No personal checks will be accepted. 6.NO PETS AND NO SMOKING. No dogs, cats or other animals shall be kept in or about the Premises by Tenant or Tenant’s guest without owner’s written consent. There shall be no smoking in the house and no butts thrown in the surrounding woods due to fire hazard and litter. 7.COVENANTS BY TENANTS. Tenant covenants and agrees to keep the Premises clean and safe; use all electrical, gas, plumbing, heating and ventilation and air-conditioning facilities and appliances in a reasonable and safe manner; conduct himself or herself, and require guest to conduct themselves in a manner that will no disturb Tenants neighbors; and to take care not to intentionally or negligently destroy damage or remove any part of the Premises, and that he or she will not permit an person to do so. Tenant agrees to pay all costs resulting from the intentional or negligent destruction, damage, or removal of any part of the Premises by Tenant or by any of the Tenant’s guests or other persons on the Premises by Tenant’s consent. 8. BODILY INJURY AND PROPERTY DAMAGE. Owner is not an insurer of Tenants person or property. Except to the extent provided by law, Owner will not be liable to Tenant for any bodily injury or property damages suffered by Tenant or Tenant’s guest or other persons on the Premises by Tenant’s consent. 9. RULES AND REGULATIONS. Tenant agrees to comply with Owner’s reasonable and non-discriminatory rules and regulations which concern the use and occupancy of the Premises, which intend to promote the convenience, safety or welfare of tenants or preserve Owner’s property from abusive conduct. 10. TERMINATION OF LEASE. This Lease will automatically terminate at the end of the lease term. The termination of this Lease will terminate Tenant’s right to occupancy but it will not terminate any claims Tenant or Owner may have arising out of events occurring during the Lease term or during any holdover by Tenant. 11. BREACH BY TENANT. Damages. In the event of any breach of this Lease, if Owner pursues any remedies set forth herein or otherwise (and regardless of whether such remedies are prosecuted to judgment), Tenant will be liable as follows:
For all past due rent and other charges For all expenses Owner may incur for cleaning, painting and repairing Premises due to Tenant failure to leave the Premises in good condition, reasonable wear and tear expected; For any court costs incurred by Owner; and Tenant shall be liable for reasonable attorneys’ fees incurred by Owner in collecting rent, other charges or damages, and in obtaining possession of Premises. 12. NOTICES. All notices in writing required or permitted by this Lease my be delivered in person, or sent by certified mail, return receipt requested (postage prepaid) to Owner, Tenant or Agent at such party’s address, as set forth above or at such other address as a party may designate from time to time by notice given in accordance with the terms of this section; however, Tenant shall be deemed o have received notice if such notice is delivered or served at the address of the Premises.
13.HEADINGS. The headings of the sections of this Lease are inserted for convenience only and do not alter or amend the provisions that follow such headings.
14.GOVERNING LAW. This Lease was entered into and shall be construed under the law of the State of Virginia.
15.SEVERABILITY.Any provision of this Lease which is prohibited by, or unlawful or unenforceable under, Virginia law shall be ineffective only to the extent of such prohibition without invalidating the remaining provisions of this Lease.
16.FAILURE TO ENFORCE LEASE NO A WAIVER. Owner’s acceptance of rent or conduct not in compliance with Tenant’s obligations under his Lease or waiver of a breach by Tenant shall not be interpreted as a waiver of any subsequent breach or non-compliance, and this Lease shall continue in full force and effect. Tenant is hereby notified that acceptance by Owner or rent payments from Tenant with knowledge of a material non-compliance by Tenant shall not constitute a waiver of owner’s right to terminate this Lease by reason of such non-compliance.
17.JOINT AND SEVERAL LIABILITY. If more than one person signs this Lease, all persons signing shall be jointly and severally liable for all obligations of Tenant set forth on this Lease.
18.AMENDMENTS. This Lease may be amended only by a writing signed by the parties, or by a change in Owner’s rules and regulations, provided that reasonable notice of such a change is given to Tenant and provided that such changes do not substantially modify Tenant’s arrangement with Owner.
19.ENTIRE AGREEMENT. This Lease and any rules and regulations of Owner constitute the entire lease agreement between Owner and Tenant. No oral statements made by either party shall be binding.
20.NO SWIMMING. Due to the insurance and liability, no swimming is allowed in the lakes. Life preservers are provided for use when boating or kayaking.
21.WILDERNESS. The cabin is located on 150 acres of wooded wilderness area which comes with all the precautions that should be taken when occupying such an area. Bear, deer, snakes, spiders and other creatures will be sharing your acreage. Please enjoy such sightings but use common sense and caution.
22.CANCELLATION POLICY: Security deposits are non-refundable. If you cancel within 30 days we cannot refund your rental balance unless the premises is re-rented for the entire cancellation period and for the full rental amount. Cancellation requests must be made in writing. We highly recommend cancellation/interruption insurance available from InsureMyTrip by cal(PHONE NUMBER HIDDEN). Crimora Mine Retreat cannot refund money due to circumstances beyond our control including inclement weather and other natural occurrences. Four-wheel drive is needed to access the property.
